13 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 18 | | SECTION 1. Subchapter H, Chapter 161, Health and Safety |
---|
15 | 19 | | Code, is amended by adding Section 161.0877 to read as follows: |
---|
16 | 20 | | Sec. 161.0877. RETAIL SALE OF CIGARETTE, E-CIGARETTE, |
---|
17 | 21 | | VAPING APPARATUS, OR TOBACCO PRODUCT NEAR SCHOOL; CRIMINAL OFFENSE. |

18 | 22 | | (a) In this section, "vaping apparatus" means a battery-operated |
---|
19 | 23 | | or electronic device intended to deliver an aerosolized or |
---|
20 | 24 | | vaporized substance to the individual inhaling from the device, |
---|
21 | 25 | | including: |
---|
22 | 26 | | (1) an e-cigar, e-pipe, vape pen, or e-hookah; |
---|
23 | 27 | | (2) any component, part, or accessory of the device; |
---|
24 | 28 | | and |
---|
25 | 29 | | (3) any liquid, solution, or substance intended to be |
---|
26 | 30 | | aerosolized or vaporized by the device, regardless of whether the |
---|
27 | 31 | | liquid, solution, or substance includes nicotine, flavoring, or |
---|
28 | 32 | | other chemicals. |
---|
29 | 33 | | (b) A retailer commits an offense if the retailer operates a |
---|
30 | 34 | | retail establishment that sells cigarettes, e-cigarettes, vaping |
---|
31 | 35 | | apparatuses, or tobacco products within 1,000 feet of a public or |
---|
32 | 36 | | private primary or secondary school. |
---|
33 | 37 | | (c) An offense under this section is a Class A misdemeanor. |
---|
39 | 39 | | operation of a retail establishment selling cigarettes, |
---|
40 | 40 | | e-cigarettes, vaping apparatuses, or tobacco products or affect the |
---|
41 | 41 | | authority of a political subdivision to adopt or enforce an |
---|
42 | 42 | | ordinance or requirement relating to the operation of a retail |
---|
43 | 43 | | establishment selling cigarettes, e-cigarettes, vaping |
---|
44 | 44 | | apparatuses, or tobacco products if the regulation, ordinance, or |
---|
45 | 45 | | requirement is compatible with or equal to or more stringent than a |
---|
46 | 46 | | requirement prescribed by this section. |
