77 AN ACT
88 relating to the definition of fetal death certificate.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 674.001(2), Health and Safety Code, is
1111 amended to read as follows:
1212 (2) "Fetal death certificate" means a death
1313 certificate filed for:
1414 (A) any fetus weighing 350 grams or more or, if
1515 the weight is unknown, a fetus age 20 weeks or more as calculated
1616 from the start date of the last normal menstrual period to the date
1717 of delivery; or
1818 (B) a fetus of any weight or gestational age
1919 whose family member requests a death certificate.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2025.
