77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to revocation of a prosecuting attorney's license to
1010 practice law in this state on a court's finding the attorney
1111 committed certain official misconduct.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 87.018, Local Government Code, is
1414 amended by adding Subsection (i) to read as follows:
1515 (i) In addition to implementing other action authorized by
1616 this subchapter and on a finding that a prosecuting attorney
1717 accused of committing official misconduct under Section
1818 87.011(3)(B) or (C) adopted or enforced a policy described by
1919 Section 87.011(3)(B) or permitted an attorney employed by or
2020 otherwise under the direction or control of the prosecuting
2121 attorney to act as described by Section 87.011(3)(C), the court
2222 shall revoke the prosecuting attorney's license to practice law in
2323 this state.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 a proceeding to remove a prosecuting attorney from office commenced
2626 on or after the effective date of this Act. A proceeding to remove a
2727 prosecuting attorney from office commenced before the effective
2828 date of this Act is governed by the law in effect immediately before
2929 the effective date of this Act, and that law is continued in effect
3030 for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2025.
