88 AN ACT
99 relating to emergency preparedness and response plans for the
1010 continued care and safety of nursing facility and assisted living
1111 facility residents.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 242, Health and Safety
1414 Code, is amended by adding Section 242.053 to read as follows:
1515 Sec. 242.053. EMERGENCY PREPAREDNESS AND RESPONSE PLAN.
1616 (a) In this section, "emergency" means an incident likely to
1717 threaten the health, welfare, or safety of residents, personnel, or
1818 the public at a nursing facility, including a fire, an equipment
1919 failure, a power outage, a flood, an interruption in utility
2020 service, a medical emergency, or a natural or other disaster.
2121 (b) Each nursing facility shall:
2222 (1) adopt and implement an emergency preparedness and
2323 response plan for the continued care and safety of residents and the
2424 continuity of the facility's essential building systems during an
2525 emergency; and
2626 (2) prepare and annually update as necessary a written
2727 policy, including procedures, to ensure the facility activates,
2828 operates, and maintains generators or alternate power sources and
2929 fuel resources required under this section.
3030 (c) An emergency preparedness and response plan adopted in
3131 accordance with this section must:
3232 (1) require a nursing facility to install and maintain
3333 on the facility's premises:
3434 (A) an emergency generator or alternate power
3535 source;
3636 (B) a fuel supply with enough capacity to power
3737 the emergency generator or alternate power source for not less than
3838 96 hours; and
3939 (C) a carbon monoxide alarm or detector that
4040 complies with rules the executive commissioner adopts; and
4141 (2) include strategies to:
4242 (A) prevent resident complications from heat
4343 exposure during a power outage, including requiring the facility to
4444 maintain a temperature between 71 degrees and 81 degrees
4545 Fahrenheit;
4646 (B) safely transport residents to an appropriate
4747 facility when the facility's management knows the facility is
4848 unable to maintain the facility's temperature within a range safe
4949 for residents; and
5050 (C) respond to inquiries from residents' family
5151 members during an emergency.
5252 (d) Each nursing facility shall provide to facility
5353 personnel the written policy prepared in accordance with Subsection
5454 (b)(2) and relevant training on the facility's emergency
5555 preparedness and response plan adopted under this section.
5656 (e) In preparing for or responding to an emergency, a
5757 nursing facility shall follow each procedure or requirement
5858 outlined in:
5959 (1) the emergency preparedness and response plan the
6060 facility adopts under this section, including contingency
6161 procedures or requirements to meet a resident's individual medical
6262 needs; and
6363 (2) the written policy prepared in accordance with
6464 Subsection (b)(2).
6565 (f) The commission shall review and approve each nursing
6666 facility's emergency preparedness and response plan required by
6767 this section and each update to the plan. The commission may revoke
6868 a facility's license issued under this chapter for failure to
6969 comply with this section or rules adopted under this section.
7070 (g) The executive commissioner shall adopt the rules
7171 necessary to administer and enforce this section.
7272 SECTION 2. Subchapter D, Chapter 247, Health and Safety
7373 Code, is amended by adding Section 247.073 to read as follows:
7474 Sec. 247.073. EMERGENCY PREPAREDNESS AND RESPONSE PLAN.
7575 (a) In this section, "emergency" means an incident likely to
7676 threaten the health, welfare, or safety of residents, personnel, or
7777 the public at an assisted living facility, including a fire, an
7878 equipment failure, a power outage, a flood, an interruption in
7979 utility service, a medical emergency, or a natural or other
8080 disaster.
8181 (b) Each assisted living facility shall:
8282 (1) adopt and implement an emergency preparedness and
8383 response plan for the continued care and safety of residents and the
8484 continuity of the facility's essential building systems during an
8585 emergency; and
8686 (2) prepare and annually update as necessary a written
8787 policy, including procedures, to ensure the facility activates,
8888 operates, and maintains generators or alternate power sources and
8989 fuel resources required under this section.
9090 (c) An emergency preparedness and response plan adopted in
9191 accordance with this section must:
9292 (1) require an assisted living facility to install and
9393 maintain on the facility's premises:
9494 (A) an emergency generator or alternate power
9595 source;
9696 (B) a fuel supply with enough capacity to power
9797 the emergency generator or alternate power source for not less than
9898 96 hours; and
9999 (C) a carbon monoxide alarm or detector that
100100 complies with rules the executive commissioner adopts; and
101101 (2) include strategies to:
102102 (A) prevent resident complications from heat
103103 exposure during a power outage, including requiring the facility to
104104 maintain a temperature between 71 degrees and 81 degrees

125125 (f) The commission shall review and approve each assisted
126126 living facility's emergency preparedness and response plan
127127 required by this section and each update to the plan. The
128128 commission may revoke a facility's license issued under this
129129 chapter for failure to comply with this section or rules adopted
130130 under this section.
131131 (g) The executive commissioner shall adopt the rules
132132 necessary to administer and enforce this section.
133133 SECTION 3. As soon as practicable after the effective date
134134 of this Act, each nursing facility and assisted living facility
135135 shall adopt and implement an emergency preparedness and response
136136 plan as required by Sections 242.053 and 247.073, Health and Safety
137137 Code, as added by this Act.
138138 SECTION 4. As soon as practicable after the effective date
139139 of this Act, the executive commissioner of the Health and Human
140140 Services Commission shall adopt the rules required by Sections
141141 242.053 and 247.073, Health and Safety Code, as added by this Act.
142142 SECTION 5. This Act takes effect September 1, 2025.
