77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of the Task Force on Concrete Plants.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) The Task Force on Concrete Plants is
1212 established.
1313 (b) The task force shall consult with experts on and study
1414 the effects of air and noise pollution caused by concrete batch and
1515 crushing plants in this state. After completing the study, the task
1616 force shall:
1717 (1) develop recommendations for legislation to:
1818 (A) reduce air and noise pollution caused by
1919 concrete batch and crushing plants;
2020 (B) improve the processes for issuing permits for
2121 and inspecting concrete batch and crushing plants; and
2222 (C) improve enforcement of statutes and rules
2323 that apply to concrete batch and crushing plants; and
2424 (2) identify best practices to reduce air and noise
2525 pollution caused by concrete batch and crushing plants.
2626 (c) The task force is composed of the following members:
2727 (1) two members of the house of representatives
2828 appointed by the speaker of the house of representatives;
2929 (2) two members of the senate appointed by the
3030 lieutenant governor;
3131 (3) the executive director of the Texas Commission on
3232 Environmental Quality or the executive director's designee; and
3333 (4) seven members appointed by the governor as
3434 follows:
3535 (A) one member to represent concrete batch and
3636 crushing plant operators;
3737 (B) one member to represent an institution of
3838 higher education in the state who must have published research
3939 regarding environmental pollutants;
4040 (C) one member who is a toxicologist certified by
4141 the American Board of Toxicology or an equivalent entity;
4242 (D) one member who is a professional with
4343 experience in geographic information systems; and
4444 (E) three members to represent community
4545 organizations who each reside not more than five miles from a
4646 concrete batch or crushing plant.
4747 (d) The governor shall designate one member of the task
4848 force to serve as the presiding officer.
4949 (e) A member of the task force is not entitled to
5050 compensation but is entitled to reimbursement for the member's
5151 travel expenses as provided by Chapter 660, Government Code, and
5252 the General Appropriations Act.
5353 (f) Not later than December 1, 2026, the task force shall:
5454 (1) compile a report of its findings and
5555 recommendations; and
5656 (2) submit the report to the governor, the lieutenant
5757 governor, and the speaker of the house of representatives.
5858 (g) Chapter 2110, Government Code, does not apply to the
5959 task force.
6060 (h) The task force is abolished and this Act expires on
6161 January 1, 2027.
6262 SECTION 2. As soon as practicable after the effective date
6363 of this Act, the governor, the lieutenant governor, and the speaker
6464 of the house of representatives shall appoint members to the Task
6565 Force on Concrete Plants as required by this Act.
6666 SECTION 3. This Act takes effect immediately if it receives
6767 a vote of two-thirds of all the members elected to each house, as
6868 provided by Section 39, Article III, Texas Constitution. If this
6969 Act does not receive the vote necessary for immediate effect, this
7070 Act takes effect September 1, 2025.
