69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the establishment of a theft of petroleum products task
912 force.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. (a) In this Act:
1215 (1) "Commission" means the Railroad Commission of
1316 Texas.
1417 (2) "Theft of petroleum product" means conduct
1518 constituting an offense under Section 31.19, Penal Code.
1619 (b) The commission shall appoint a task force to study and
1720 make recommendations related to preventing the theft of petroleum
1821 products in this state.
1922 (c) The task force must include:
2023 (1) at least one representative from the oil and gas
2124 industry;
2225 (2) at least one representative from an energy trade
2326 association; and
2427 (3) representatives from local, state, and federal law
2528 enforcement agencies.
2629 (d) The commission shall designate a member of the task
2730 force as the presiding officer.
2831 (e) The task force shall meet at least quarterly at the call
2932 of the presiding officer. A task force meeting may be conducted
3033 virtually through the Internet.
3134 (f) The task force shall conduct an ongoing study of the
3235 theft of petroleum products in this state. In conducting the study,
3336 the task force shall:
3437 (1) review laws and regulations addressing the theft
3538 of petroleum products in other jurisdictions, including
3639 international political and economic organizations;
3740 (2) analyze:
3841 (A) the impact of the theft of petroleum products
3942 on the collection of sales tax;
4043 (B) the long-term economic impacts of the theft
4144 of petroleum products; and
4245 (C) the advantages and disadvantages of taking
4346 various actions to reduce the theft of petroleum products; and
4447 (3) make recommendations regarding:
4548 (A) theft of petroleum product outreach and
4649 prevention programs, including coordination among stakeholders,
4750 including local, state, and federal law enforcement agencies; and
4851 (B) training for law enforcement officers and
4952 prosecutors on effective strategies for combating the theft of
5053 petroleum products.
5154 (g) In conducting the study under Subsection (f) of this
5255 section, the members of the task force may:
5356 (1) consult with any organization, governmental
5457 entity, or person the task force considers necessary; and
5558 (2) collaborate and share information relating to an
5659 active criminal investigation with one another regardless of
5760 whether the information would otherwise be confidential and not
5861 subject to disclosure under Chapter 552, Government Code.
5962 (h) Not later than December 1 of each even-numbered year,
6063 the task force shall prepare and submit a report of the study
6164 conducted under Subsection (f) of this section to the governor, the
6265 lieutenant governor, the speaker of the house of representatives,
6366 the commission, and each standing committee of the legislature with
6467 primary jurisdiction over oil and gas matters.
6568 (i) The report submitted under Subsection (h) of this
6669 section:
6770 (1) must include legislative and other
6871 recommendations to increase transparency, improve security,
6972 enhance consumer protections, prevent the theft of petroleum
7073 products, and address the long-term economic impact of the theft of
7174 petroleum products; and
7275 (2) may be submitted electronically.
7376 (j) Chapter 2110, Government Code, does not apply to the
7477 duration of the task force or to the designation of the task force's
7578 presiding officer.
7679 SECTION 2. As soon as practicable after the effective date
7780 of this Act, the Railroad Commission of Texas shall appoint the
7881 theft of petroleum products task force as required by this Act.
7982 SECTION 3. This Act expires December 31, 2030.
8083 SECTION 4. This Act takes effect September 1, 2025.
