77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the use of green stormwater infrastructure in new state
1010 buildings.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter I, Chapter 2166,
1313 Government Code, is amended to read as follows:
1414 SUBCHAPTER I. ENVIRONMENTAL CONSERVATION AND PROTECTION [OF ENERGY
1515 AND WATER]
1616 SECTION 2. Subchapter I, Chapter 2166, Government Code, is
1717 amended by adding Section 2166.409 to read as follows:
1818 Sec. 2166.409. GREEN STORMWATER INFRASTRUCTURE IN NEW
1919 BUILDING CONSTRUCTION. (a) In this section, "green stormwater
2020 infrastructure" means infrastructure that absorbs and treats
2121 rainwater in order to limit erosion, habitat damage, property
2222 damage, and water pollution caused by flooding and to protect water
2323 quality, including rain gardens, bioswales, permeable pavement,
2424 green roofs and walls, and rain barrels.
2525 (b) This section applies to the construction of a new state
2626 building, including a building project otherwise exempt from this
2727 chapter under Section 2166.003.
2828 (c) The commission, or the governing body of the appropriate
2929 agency that is undertaking a building project otherwise exempt from
3030 this chapter under Section 2166.003, shall use green stormwater
3131 infrastructure in the construction of a state building.
3232 SECTION 3. (a) The changes in law made by this Act apply
3333 only to a new state agency building contract or construction
3434 project for which a state agency first advertises or otherwise
3535 requests bids, proposals, offers, or qualifications, or makes a
3636 similar solicitation, on or after the effective date of this Act.
3737 (b) A new state agency building contract or construction
3838 project for which a state agency first advertises or otherwise
3939 requests bids, proposals, offers, or qualifications, or makes a
4040 similar solicitation, before the effective date of this Act is
4141 governed by the law as it existed immediately before the effective
4242 date of this Act, and that law is continued in effect for that
4343 purpose.
4444 SECTION 4. This Act takes effect September 1, 2025.
