| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Subchapter I, Chapter 2166, |
|---|
| 13 | 13 | | Government Code, is amended to read as follows: |

| 14 | 14 | | SUBCHAPTER I. ENVIRONMENTAL CONSERVATION AND PROTECTION [OF ENERGY |

| 16 | 16 | | SECTION 2. Subchapter I, Chapter 2166, Government Code, is |
|---|
| 17 | 17 | | amended by adding Section 2166.409 to read as follows: |
|---|
| 18 | 18 | | Sec. 2166.409. GREEN STORMWATER INFRASTRUCTURE IN NEW |
|---|
| 19 | 19 | | BUILDING CONSTRUCTION. (a) In this section, "green stormwater |
|---|
| 20 | 20 | | infrastructure" means infrastructure that absorbs and treats |
|---|
| 21 | 21 | | rainwater in order to limit erosion, habitat damage, property |
|---|
| 22 | 22 | | damage, and water pollution caused by flooding and to protect water |
|---|
| 23 | 23 | | quality, including rain gardens, bioswales, permeable pavement, |
|---|
| 24 | 24 | | green roofs and walls, and rain barrels. |
|---|
| 25 | 25 | | (b) This section applies to the construction of a new state |
|---|
| 26 | 26 | | building, including a building project otherwise exempt from this |
|---|
| 27 | 27 | | chapter under Section 2166.003. |
|---|
| 28 | 28 | | (c) The commission, or the governing body of the appropriate |
|---|
| 29 | 29 | | agency that is undertaking a building project otherwise exempt from |
|---|
| 30 | 30 | | this chapter under Section 2166.003, shall use green stormwater |
|---|
| 31 | 31 | | infrastructure in the construction of a state building. |
|---|
| 32 | 32 | | SECTION 3. (a) The changes in law made by this Act apply |
|---|
| 33 | 33 | | only to a new state agency building contract or construction |
|---|
| 34 | 34 | | project for which a state agency first advertises or otherwise |
|---|
| 35 | 35 | | requests bids, proposals, offers, or qualifications, or makes a |
|---|
| 36 | 36 | | similar solicitation, on or after the effective date of this Act. |
|---|
| 37 | 37 | | (b) A new state agency building contract or construction |
|---|
| 38 | 38 | | project for which a state agency first advertises or otherwise |
|---|
| 39 | 39 | | requests bids, proposals, offers, or qualifications, or makes a |
|---|
| 40 | 40 | | similar solicitation, before the effective date of this Act is |
|---|
| 41 | 41 | | governed by the law as it existed immediately before the effective |
|---|
| 42 | 42 | | date of this Act, and that law is continued in effect for that |
|---|
| 43 | 43 | | purpose. |
|---|
| 44 | 44 | | SECTION 4. This Act takes effect September 1, 2025. |
