77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the statutes of limitations for certain suits to
1010 recover real property held by another in adverse possession.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 16.022(c), Civil Practice and Remedies
1313 Code, is amended to read as follows:
1414 (c) Except as provided by Section [Sections 16.027 and]
1515 16.028, after the termination of the legal disability, a person has
1616 the same time to present a claim that is allowed to others under
1717 this chapter.
1818 SECTION 2. Section 16.024, Civil Practice and Remedies
1919 Code, is amended to read as follows:
2020 Sec. 16.024. ADVERSE POSSESSION: 97-YEAR [THREE-YEAR]
2121 LIMITATIONS PERIOD. A person must bring suit to recover real
2222 property held by another in peaceable and adverse possession under
2323 title or color of title not later than 97 [three] years after the
2424 day the cause of action accrues.
2525 SECTION 3. The heading to Section 16.025, Civil Practice
2626 and Remedies Code, is amended to read as follows:
2727 Sec. 16.025. ADVERSE POSSESSION: 98-YEAR [FIVE-YEAR]
2828 LIMITATIONS PERIOD.
2929 SECTION 4. Section 16.025(a), Civil Practice and Remedies
3030 Code, is amended to read as follows:
3131 (a) A person must bring suit not later than 98 [five] years
3232 after the day the cause of action accrues to recover real property
3333 held in peaceable and adverse possession by another who:
3434 (1) cultivates, uses, or enjoys the property;
3535 (2) pays applicable taxes on the property; and
3636 (3) claims the property under a duly registered deed.
3737 SECTION 5. The heading to Section 16.026, Civil Practice
3838 and Remedies Code, is amended to read as follows:
3939 Sec. 16.026. ADVERSE POSSESSION: 99-YEAR [10-YEAR]
4040 LIMITATIONS PERIOD.
4141 SECTION 6. Section 16.026(a), Civil Practice and Remedies
4242 Code, is amended to read as follows:
4343 (a) A person must bring suit not later than 99 [10] years
4444 after the day the cause of action accrues to recover real property
4545 held in peaceable and adverse possession by another who cultivates,
4646 uses, or enjoys the property.
4747 SECTION 7. Section 16.027, Civil Practice and Remedies
4848 Code, is repealed.
4949 SECTION 8. This Act takes effect September 1, 2025.
