12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter A, Chapter 29, Education Code, is |
---|
14 | 14 | | amended by adding Section 29.0053 to read as follows: |
---|
15 | 15 | | Sec. 29.0053. INDIVIDUALIZED EDUCATION PROGRAM SUPPLEMENT |
---|
16 | 16 | | FOR STUDENTS IN ALTERNATIVE SPECIAL EDUCATION SETTINGS. (a) In |
---|
17 | 17 | | this section: |
---|
18 | 18 | | (1) "Alternative special education setting" means: |
---|
19 | 19 | | (A) a school district campus at which 90 percent |
---|
20 | 20 | | or more of the enrolled students are provided special education and |
---|
21 | 21 | | related services; or |
---|
22 | 22 | | (B) a self-contained program that: |
---|
23 | 23 | | (i) operates as a separate campus from the |
---|
24 | 24 | | campus in which the program is located; and |
---|
25 | 25 | | (ii) provides special education and related |
---|
26 | 26 | | services to 90 percent or more of the students in regular |
---|
27 | 27 | | attendance. |
---|
28 | 28 | | (2) "Committee" means a committee established under |
---|
29 | 29 | | Section 29.005(a). |
---|
30 | 30 | | (b) In developing or modifying an individualized education |
---|
31 | 31 | | program for a student who receives special education or related |
---|
32 | 32 | | services in an alternative special education setting, the student's |
---|
33 | 33 | | committee shall develop and include in an attached supplement to |
---|
34 | 34 | | the written statement of the student's individualized education |
---|
35 | 35 | | program individualized, measurable goals for academic and |
---|
36 | 36 | | social-emotional and behavioral growth that would allow the student |
---|
37 | 37 | | to be returned to a general education setting. The committee must |
---|
38 | 38 | | meet at least once each semester to review the student's progress |
---|
39 | 39 | | toward the goals developed under this subsection and determine |
---|
40 | 40 | | whether the student may be returned to a general education setting. |
---|
41 | 41 | | SECTION 2. Section 29.011, Education Code, is amended by |
---|
42 | 42 | | adding Subsection (a-3) to read as follows: |
---|
43 | 43 | | (a-3) The procedures adopted under Subsection (a) must |
---|
44 | 44 | | require the admission, review, and dismissal committee for a |
---|
45 | 45 | | student who is at least 18 years of age and receiving special |
---|
46 | 46 | | education or related services in an alternative special education |
---|
47 | 47 | | setting, as defined by Section 29.0053, to develop and include in an |
---|
48 | 48 | | attached supplement to the written statement of the student's |
---|
49 | 49 | | individualized education program individualized, measurable goals |
---|
50 | 50 | | for the issues described by Subsections (a)(7) and (8). |
---|
51 | 51 | | SECTION 3. This Act applies beginning with the 2025-2026 |
---|
52 | 52 | | school year. |
---|
53 | 53 | | SECTION 4. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2025. |
