88 AN ACT
99 relating to required individualized education program supplements
1010 for certain public school students placed in alternative special
1111 education settings.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1414 amended by adding Section 29.0053 to read as follows:
1515 Sec. 29.0053. INDIVIDUALIZED EDUCATION PROGRAM SUPPLEMENT
1616 FOR STUDENTS IN ALTERNATIVE SPECIAL EDUCATION SETTINGS. (a) In
1717 this section:
1818 (1) "Alternative special education setting" means:
1919 (A) a school district campus at which 90 percent
2020 or more of the enrolled students are provided special education and
2121 related services; or
2222 (B) a self-contained program that:
2323 (i) operates as a separate campus from the
2424 campus in which the program is located; and
2525 (ii) provides special education and related
2626 services to 90 percent or more of the students in regular
2727 attendance.
2828 (2) "Committee" means a committee established under
2929 Section 29.005(a).
3030 (b) In developing or modifying an individualized education
3131 program for a student who receives special education or related
3232 services in an alternative special education setting, the student's
3333 committee shall develop and include in an attached supplement to
3434 the written statement of the student's individualized education
3535 program individualized, measurable goals for academic and
3636 social-emotional and behavioral growth that would allow the student
3737 to be returned to a general education setting. The committee must
3838 meet at least once each semester to review the student's progress
3939 toward the goals developed under this subsection and determine
4040 whether the student may be returned to a general education setting.
4141 SECTION 2. Section 29.011, Education Code, is amended by
4242 adding Subsection (a-3) to read as follows:
4343 (a-3) The procedures adopted under Subsection (a) must
4444 require the admission, review, and dismissal committee for a
4545 student who is at least 18 years of age and receiving special
4646 education or related services in an alternative special education
4747 setting, as defined by Section 29.0053, to develop and include in an
4848 attached supplement to the written statement of the student's
4949 individualized education program individualized, measurable goals
5050 for the issues described by Subsections (a)(7) and (8).
5151 SECTION 3. This Act applies beginning with the 2025-2026
5252 school year.
5353 SECTION 4. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2025.
