610 A BILL TO BE ENTITLED
711 AN ACT
812 relating to a compliance agreement for the suspension of an
913 enforcement action against a regional water supply, sewer,
1014 wastewater treatment, or solid waste disposal service for certain
1115 violations.
1216 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1317 SECTION 1. Sections 7.0026(b) and (c), Water Code, are
1418 amended to read as follows:
1519 (b) If a water supply, sewer, wastewater treatment, or solid
1620 waste disposal service operated by or for a municipality, [or]
1721 county, regional service area, or unincorporated service area is
1822 being integrated into a regional water supply, sewer, wastewater
1923 treatment, or solid waste disposal service administered by another
2024 entity, including a retail public utility, the commission may enter
2125 into a compliance agreement with the regional service under which
2226 the commission will not initiate an enforcement action against the
2327 regional service for existing or anticipated violations resulting
2428 from the operation by the regional service of the service being
2529 integrated. A compliance agreement under this section must
2630 include provisions necessary to bring the service being integrated
2731 into compliance.
2832 (c) If a water supply, sewer, or wastewater treatment
2933 service operated by a retail public utility, other than a
3034 municipality or county, is being integrated into a regional water
3135 supply, sewer, or wastewater treatment service administered by
3236 another entity, including a separate retail public utility, the
3337 commission may enter into a compliance agreement with the regional
3438 service under which the commission will not initiate an enforcement
3539 action against the regional service for existing or anticipated
3640 violations resulting from the operation by the regional service of
3741 the service being integrated. A compliance agreement under this
3842 section must include provisions necessary to bring the service
3943 being integrated into compliance.
4044 SECTION 2. This Act takes effect September 1, 2025.
