77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the use of a building owned or controlled by a public
1010 school as a polling place.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 43.031(c) and (e), Election Code, are
1313 amended to read as follows:
1414 (c) The building selected for a polling place shall be a
1515 public building if practicable. Except as provided by Subsection
1616 (e), the [The] entity that owns or controls a public building shall
1717 make the building available for use as a polling place in any
1818 election that covers territory in which the building is located. If
1919 more than one authority requests the use of the building for the
2020 same day and simultaneous use is impracticable, the entity that
2121 owns or controls the building shall determine which authority may
2222 use the building.
2323 (e) A polling place may not be located:
2424 (1) at a building owned or controlled by a school
2525 district or an open-enrollment charter school unless:
2626 (A) the building is not located on or adjacent to
2727 a school campus; or
2828 (B) the building is located in a county with a
2929 population of 50,000 or less and the election authority cannot
3030 identify a reasonable alternative polling place; or
3131 (2) at the residence of a person who is:
3232 (A) [(1)] a candidate for an elective office,
3333 including an office of a political party; or
3434 (B) [(2)] related within the third degree by
3535 consanguinity or the second degree by affinity, as determined under
3636 Chapter 573, Government Code, to a candidate described by Paragraph
3737 (A) [Subdivision (1)].
3838 SECTION 2. This Act takes effect September 1, 2025.
