| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 43.031(c) and (e), Election Code, are |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (c) The building selected for a polling place shall be a |
|---|
| 15 | 15 | | public building if practicable. Except as provided by Subsection |
|---|
| 16 | 16 | | (e), the [The] entity that owns or controls a public building shall |
|---|
| 17 | 17 | | make the building available for use as a polling place in any |
|---|
| 18 | 18 | | election that covers territory in which the building is located. If |
|---|
| 19 | 19 | | more than one authority requests the use of the building for the |
|---|
| 20 | 20 | | same day and simultaneous use is impracticable, the entity that |
|---|
| 21 | 21 | | owns or controls the building shall determine which authority may |
|---|
| 22 | 22 | | use the building. |
|---|
| 23 | 23 | | (e) A polling place may not be located: |
|---|
| 24 | 24 | | (1) at a building owned or controlled by a school |
|---|
| 25 | 25 | | district or an open-enrollment charter school unless: |
|---|
| 26 | 26 | | (A) the building is not located on or adjacent to |
|---|
| 27 | 27 | | a school campus; or |
|---|
| 28 | 28 | | (B) the building is located in a county with a |
|---|
| 29 | 29 | | population of 50,000 or less and the election authority cannot |
|---|
| 30 | 30 | | identify a reasonable alternative polling place; or |
|---|
| 31 | 31 | | (2) at the residence of a person who is: |
|---|
| 32 | 32 | | (A) [(1)] a candidate for an elective office, |
|---|
| 33 | 33 | | including an office of a political party; or |
|---|
| 34 | 34 | | (B) [(2)] related within the third degree by |
|---|
| 35 | 35 | | consanguinity or the second degree by affinity, as determined under |
|---|
| 36 | 36 | | Chapter 573, Government Code, to a candidate described by Paragraph |
|---|
| 37 | 37 | | (A) [Subdivision (1)]. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2025. |
