611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to surveillance cameras for certain housing developments
914 that receive an allocation of low income housing tax credits.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Subchapter DD, Chapter 2306, Government Code, is
1217 amended by adding Section 2306.6741 to read as follows:
1318 Sec. 2306.6741. SURVEILLANCE CAMERAS REQUIRED. (a) A
1419 development that has received an allocation of low income housing
1520 tax credits under this subchapter must install and maintain
1621 operable exterior surveillance cameras at appropriate locations
1722 throughout the development.
18- (b) This section does not apply to a development that:
19- (1) is located in a rural area; or
20- (2) received an allocation of low income housing tax
21- credits before September 1, 2025.
22- SECTION 2. This Act takes effect September 1, 2025.
23+ (b) This section does not apply to a development located in
24+ a rural area.
25+ SECTION 2. Section 2306.6741, Government Code, as added by
26+ this Act, applies only to a development that receives an allocation
27+ of low income housing tax credits from an application cycle that is
28+ based on the 2026 qualified allocation plan or a subsequent plan
29+ adopted by the governing board of the Texas Department of Housing
30+ and Community Affairs. A development that receives an allocation
31+ of low income housing tax credits from an application cycle that is
32+ based on an earlier qualified allocation plan is governed by the law
33+ in effect on the date the application cycle began, and the former
34+ law is continued in effect for that purpose.
35+ SECTION 3. This Act takes effect September 1, 2025.
