77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an exemption from certain requirements regarding
1010 diversity, equity, or inclusion initiatives for certain
1111 scholarships provided by public institutions of higher education.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 51.3525(d), Education Code, is amended
1414 to read as follows:
1515 (d) Subsection (b)(1) may not be construed to apply to:
1616 (1) academic course instruction;
1717 (2) scholarly research or a creative work by an
1818 institution of higher education's students, faculty, or other
1919 research personnel or the dissemination of that research or work;
2020 (3) an activity of a student organization registered
2121 with or recognized by an institution of higher education;
2222 (4) guest speakers or performers on short-term
2323 engagements;
2424 (5) a policy, practice, procedure, program, or
2525 activity to enhance student academic achievement or postgraduate
2626 outcomes that is designed and implemented without regard to race,
2727 sex, color, or ethnicity;
2828 (6) data collection; [or]
2929 (7) student recruitment or admissions; or
3030 (8) a scholarship funded by private money held in
3131 trust by or endowed to an institution of higher education or a
3232 foundation affiliated with the institution.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
