12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subtitle A, Title 10, Insurance Code, is amended |
---|
14 | 14 | | by adding Chapter 1808 to read as follows: |

15 | 15 | | CHAPTER 1808. PROHIBITED PRACTICES RELATED TO PERSONAL LINES |
---|
16 | 16 | | Sec. 1808.001. PERSONAL AUTOMOBILE OR RESIDENTIAL PROPERTY |
---|
17 | 17 | | PREMIUM INCREASE PROHIBITED FOR CLAIM SUBJECT TO IMMUNITY. (a) |
---|
18 | 18 | | This section applies to an insurer writing personal automobile or |
---|
19 | 19 | | residential property insurance in this state, including an |
---|
20 | 20 | | insurance company, reciprocal or interinsurance exchange, mutual |
---|
21 | 21 | | insurance company, capital stock company, county mutual insurance |
---|
22 | 22 | | company, farm mutual insurance company, Lloyd's plan, or other |
---|
23 | 23 | | insurer. |
---|
24 | 24 | | (b) An insurer may not increase the premium on a personal |
---|
25 | 25 | | automobile or residential property insurance policy solely as a |
---|
26 | 26 | | result of a claim made under the policy for damage or injury |
---|
27 | 27 | | sustained as a result of an action by a governmental body, officer, |
---|
28 | 28 | | or employee who has sovereign, governmental, or official immunity |
---|
29 | 29 | | from suit or liability for the claim. |
---|
30 | 30 | | SECTION 2. Section 1808.001, Insurance Code, as added by |
---|
31 | 31 | | this Act, applies only to an insurance policy delivered, issued for |
---|
32 | 32 | | delivery, or renewed on or after January 1, 2026. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2025. |
