88 AN ACT
99 relating to personal automobile or residential property insurance
1010 premium increases for claims subject to sovereign, governmental, or
1111 official immunity.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle A, Title 10, Insurance Code, is amended
1414 by adding Chapter 1808 to read as follows:
1515 CHAPTER 1808. PROHIBITED PRACTICES RELATED TO PERSONAL LINES
1616 Sec. 1808.001. PERSONAL AUTOMOBILE OR RESIDENTIAL PROPERTY
1717 PREMIUM INCREASE PROHIBITED FOR CLAIM SUBJECT TO IMMUNITY. (a)
1818 This section applies to an insurer writing personal automobile or
1919 residential property insurance in this state, including an
2020 insurance company, reciprocal or interinsurance exchange, mutual
2121 insurance company, capital stock company, county mutual insurance
2222 company, farm mutual insurance company, Lloyd's plan, or other
2323 insurer.
2424 (b) An insurer may not increase the premium on a personal
2525 automobile or residential property insurance policy solely as a
2626 result of a claim made under the policy for damage or injury
2727 sustained as a result of an action by a governmental body, officer,
2828 or employee who has sovereign, governmental, or official immunity
2929 from suit or liability for the claim.
3030 SECTION 2. Section 1808.001, Insurance Code, as added by
3131 this Act, applies only to an insurance policy delivered, issued for
3232 delivery, or renewed on or after January 1, 2026.
3333 SECTION 3. This Act takes effect September 1, 2025.
