| 9 | 9 | | relating to the notice of rulemaking proceedings provided to |
|---|
| 10 | 10 | | certain persons by state agencies. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 2001.0261, Government Code, is amended |
|---|
| 13 | 13 | | by amending Subsections (c) and (d) and adding Subsection (e) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (c) A [The] state agency shall provide the notice required |
|---|
| 16 | 16 | | under Subsection (b) electronically to the recipient's [person's] |
|---|
| 17 | 17 | | designated Capitol e-mail address or to another e-mail address |
|---|
| 18 | 18 | | provided by the recipient [person] to the agency for the purpose of |
|---|
| 19 | 19 | | receiving the notice. The notice must: |
|---|
| 20 | 20 | | (1) be specifically addressed and directed to the |
|---|
| 21 | 21 | | recipient; |
|---|
| 22 | 22 | | (2) include the bill number for the legislation that |
|---|
| 23 | 23 | | enacted the statutory authority under which the proposed rule that |
|---|
| 24 | 24 | | is the subject of the notice is to be adopted; and |
|---|
| 25 | 25 | | (3) if practicable, provide a link to the proposed |
|---|
| 26 | 26 | | rule that is the subject of the notice or include a copy of the |
|---|
| 27 | 27 | | proposed rule as an attachment to the notice. |
|---|
| 28 | 28 | | (d) A state agency may not provide the notice required under |
|---|
| 29 | 29 | | Subsection (b) to a recipient by: |
|---|
| 30 | 30 | | (1) including the recipient on an e-mail list service |
|---|
| 31 | 31 | | the agency uses to provide periodic announcements of the agency's |
|---|
| 32 | 32 | | proposed rules to members of the public or the legislature |
|---|
| 33 | 33 | | generally; or |
|---|
| 34 | 34 | | (2) providing the notice in an e-mail sent by the |
|---|
| 35 | 35 | | agency in its regular course of business to multiple recipients. |
|---|
| 36 | 36 | | (e) Failure to provide the notice required under Subsection |
|---|
| 37 | 37 | | (b) does not invalidate a rule adopted by a state agency or an |
|---|
| 38 | 38 | | action taken by the agency under that rule. |
|---|
| 39 | 39 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 40 | 40 | | to a notice under Section 2001.0261, Government Code, provided on |
|---|
| 41 | 41 | | or after the effective date of this Act. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2025. |
