77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the notice of rulemaking proceedings provided to
1010 certain persons by state agencies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2001.0261, Government Code, is amended
1313 by amending Subsections (c) and (d) and adding Subsection (e) to
1414 read as follows:
1515 (c) A [The] state agency shall provide the notice required
1616 under Subsection (b) electronically to the recipient's [person's]
1717 designated Capitol e-mail address or to another e-mail address
1818 provided by the recipient [person] to the agency for the purpose of
1919 receiving the notice. The notice must:
2020 (1) be specifically addressed and directed to the
2121 recipient;
2222 (2) include the bill number for the legislation that
2323 enacted the statutory authority under which the proposed rule that
2424 is the subject of the notice is to be adopted; and
2525 (3) if practicable, provide a link to the proposed
2626 rule that is the subject of the notice or include a copy of the
2727 proposed rule as an attachment to the notice.
2828 (d) A state agency may not provide the notice required under
2929 Subsection (b) to a recipient by:
3030 (1) including the recipient on an e-mail list service
3131 the agency uses to provide periodic announcements of the agency's
3232 proposed rules to members of the public or the legislature
3333 generally; or
3434 (2) providing the notice in an e-mail sent by the
3535 agency in its regular course of business to multiple recipients.
3636 (e) Failure to provide the notice required under Subsection
3737 (b) does not invalidate a rule adopted by a state agency or an
3838 action taken by the agency under that rule.
3939 SECTION 2. The change in law made by this Act applies only
4040 to a notice under Section 2001.0261, Government Code, provided on
4141 or after the effective date of this Act.
4242 SECTION 3. This Act takes effect September 1, 2025.
