66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to reporting certain information regarding the placement
99 of children and suits filed by the Department of Family and
1010 Protective Services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 264.017(b) and (f), Family Code, are
1313 amended to read as follows:
1414 (b) The department shall provide the report required by
1515 Subsection (a) to the legislature and shall publish the report and
1616 make the report available electronically to the public not later
1717 than February 1 of each year. The report must include, with respect
1818 to the preceding year:
1919 (1) information on the number and disposition of
2020 reports of child abuse and neglect received by the department;
2121 (2) information on the number of clients for whom the
2222 department took protective action, including investigations,
2323 alternative responses, and court-ordered removals;
2424 (3) information on the number of clients for whom the
2525 department provided services in each program administered by the
2626 child protective services division, including investigations,
2727 alternative responses, family-based safety services,
2828 conservatorship, post-adoption services, and transitional living
2929 services;
3030 (4) the number of children in this state who died as a
3131 result of child abuse or neglect;
3232 (5) the number of children described by Subdivision
3333 (4) for whom the department was the children's managing conservator
3434 at the time of death;
3535 (6) information on the timeliness of the department's
3636 initial contact in an investigation or alternative response;
3737 (7) information on the response time by the department
3838 in commencing services to families and children for whom an
3939 allegation of child abuse or neglect has been made;
4040 (8) information regarding child protection staffing
4141 and caseloads by program area;
4242 (9) information on the permanency goals in place and
4343 achieved for children in the managing conservatorship of the
4444 department, including information on the timeliness of achieving
4545 the goals, the stability of the children's placement in foster
4646 care, and the proximity of placements to the children's home
4747 counties;
4848 (10) the number of children who suffer from a severe
4949 emotional disturbance and for whom the department is appointed
5050 managing conservator, including statistics on appointments as
5151 joint managing conservator, due to an individual voluntarily
5252 relinquishing custody of a child solely to obtain mental health
5353 services for the child;
5454 (11) the number of children who are pregnant or a
5555 parent while in the managing conservatorship of the department and
5656 the number of the children born to a parent in the managing
5757 conservatorship of the department who are placed in the managing
5858 conservatorship of the department;
5959 (12) the number of children who are missing from the
6060 children's substitute care provider while in the managing
6161 conservatorship of the department; [and]
6262 (13) the number of children who were victims of
6363 trafficking under Chapter 20A, Penal Code, while in the managing
6464 conservatorship of the department; and
6565 (14) information on the outcome of each suit filed by
6666 the department and the type of placement of the child during the
6767 pendency of the suit.
6868 (f) In addition to the other reports required by this
6969 section, the department shall publish on the department's Internet
7070 website a monthly report containing the following information for
7171 the preceding month:
7272 (1) with respect to parental child safety placement
7373 agreements:
7474 (A) [(1)] the number of children placed under a
7575 parental child safety placement agreement, disaggregated by:
7676 (i) the child's age, race, gender,
7777 ethnicity, and county of residence;
7878 (ii) the annualized incomes of the parent
7979 or other person with whom the child resides and the caregiver of the
8080 child; and
8181 (iii) whether the child has previously been
8282 in the managing conservatorship of the department;
8383 (B) the number of parental child safety placement
8484 agreements in effect on the last day of the month;
8585 (C) [(2)] the average duration of a placement
8686 under a parental child safety placement agreement;
8787 (D) [(3)] the average duration of a placement
8888 under a parental child safety placement agreement during an
8989 investigation; and
9090 (E) [(4)] the percentage of children removed
9191 from a placement under a parental child safety placement agreement
9292 and placed in the managing conservatorship of the department; and
9393 (2) by child protective services region with respect
9494 to:
9595 (A) authorization agreements executed under
9696 Chapter 34 regarding a child who is the subject of an investigation
9797 of abuse or neglect, a suit filed by the department, or an agreement
9898 under which the department provides services to the child's parent:
9999 (i) the number of authorization agreements
100100 executed;
101101 (ii) the number of children subject to
102102 authorization agreements, disaggregated by the child's race and
103103 gender; and
104104 (iii) the average duration of an
105105 authorization agreement; and
106106 (B) court orders for temporary authorization for
107107 care of a child under Chapter 35 regarding a child who is the
108108 subject of an investigation of abuse or neglect, a suit filed by the
109109 department, or an agreement under which the department provides
110110 services to the child's parent:
111111 (i) the number of orders signed;
112112 (ii) the number of children subject to
113113 orders, disaggregated by the child's race and gender; and
114114 (iii) the average duration of an order.
115115 SECTION 2. This Act takes effect September 1, 2025.
