11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 92, Property Code, is | |
13 | 13 | amended by adding Section 92.027 to read as follows: | |
14 | 14 | Sec. 92.027. CERTAIN MAIL FEES PROHIBITED. (a) In this | |
15 | 15 | section: | |
16 | 16 | (1) "Landlord" includes a manager or agent of the | |
17 | 17 | landlord. | |
18 | 18 | (2) "Mail" means a letter, postal card, package, bag, | |
19 | 19 | or other sealed article that is delivered by the United States | |
20 | 20 | Postal Service, a common carrier, or another delivery service. | |
21 | 21 | (b) This section applies only to a property with at least | |
22 | 22 | six dwelling units that are under common ownership. | |
23 | 23 | (c) A landlord may not: | |
24 | 24 | (1) charge a tenant a fee to receive the tenant's mail; | |
25 | 25 | or | |
26 | 26 | (2) require a tenant to use a service that charges the | |
27 | 27 | tenant a fee to receive, store, or otherwise handle the tenant's | |
28 | 28 | mail. | |
29 | 29 | (d) A landlord may offer a tenant an optional fee-based mail | |
30 | 30 | service for the receipt, storage, or other handling of the tenant's | |
31 | 31 | mail. | |
32 | 32 | SECTION 2. The changes in law made by this Act apply only to | |
33 | 33 | a lease entered into or renewed on or after the effective date of | |
34 | 34 | this Act. | |
35 | 35 | SECTION 3. This Act takes effect September 1, 2025. |
