77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to mail fees charged to tenants of certain residential
1010 properties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 92, Property Code, is
1313 amended by adding Section 92.027 to read as follows:
1414 Sec. 92.027. CERTAIN MAIL FEES PROHIBITED. (a) In this
1515 section:
1616 (1) "Landlord" includes a manager or agent of the
1717 landlord.
1818 (2) "Mail" means a letter, postal card, package, bag,
1919 or other sealed article that is delivered by the United States
2020 Postal Service, a common carrier, or another delivery service.
2121 (b) This section applies only to a property with at least
2222 six dwelling units that are under common ownership.
2323 (c) A landlord may not:
2424 (1) charge a tenant a fee to receive the tenant's mail;
2525 or
2626 (2) require a tenant to use a service that charges the
2727 tenant a fee to receive, store, or otherwise handle the tenant's
2828 mail.
2929 (d) A landlord may offer a tenant an optional fee-based mail
3030 service for the receipt, storage, or other handling of the tenant's
3131 mail.
3232 SECTION 2. The changes in law made by this Act apply only to
3333 a lease entered into or renewed on or after the effective date of
3434 this Act.
3535 SECTION 3. This Act takes effect September 1, 2025.
