| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subchapter A, Chapter 92, Property Code, is | |
| 13 | 13 | amended by adding Section 92.0192 to read as follows: | |
| 14 | 14 | Sec. 92.0192. CERTAIN UTILITY NONPAYMENT OR LATE FEES | |
| 15 | 15 | PROHIBITED. (a) In this section, "landlord" includes a manager or | |
| 16 | 16 | agent of the landlord. | |
| 17 | 17 | (b) Except as provided by Subsection (c), a landlord may not | |
| 18 | 18 | collect from a tenant a fee incurred by the landlord as a result of | |
| 19 | 19 | the landlord's nonpayment or late payment to a utility company for a | |
| 20 | 20 | utility service furnished by the landlord to the tenant under the | |
| 21 | 21 | lease or another agreement. | |
| 22 | 22 | (c) Subsection (b) does not apply to a tenant who is | |
| 23 | 23 | delinquent in payment to the landlord for a utility service | |
| 24 | 24 | furnished by the landlord to the tenant under the lease or other | |
| 25 | 25 | agreement. | |
| 26 | 26 | (d) This section does not restrict a landlord's authority to | |
| 27 | 27 | collect from a tenant a late fee or other charge for an amount owed | |
| 28 | 28 | by the tenant to the landlord under the lease or other agreement. | |
| 29 | 29 | SECTION 2. The changes in law made by this Act apply only to | |
| 30 | 30 | a lease or other agreement entered into or renewed on or after the | |
| 31 | 31 | effective date of this Act. | |
| 32 | 32 | SECTION 3. This Act takes effect September 1, 2025. |
