11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 38.211, Education Code, is amended by | |
13 | 13 | adding Subsection (b-1) and amending Subsection (c) to read as | |
14 | 14 | follows: | |
15 | 15 | (b-1) The commissioner of state health services or, if the | |
16 | 16 | commissioner is not a physician, the chief medical executive of the | |
17 | 17 | Department of State Health Services may issue a statewide standing | |
18 | 18 | order prescribing epinephrine auto-injectors to a school district, | |
19 | 19 | open-enrollment charter school, or private school. | |
20 | 20 | (c) The standing order under Subsection (b) or (b-1) is not | |
21 | 21 | required to be patient-specific, and the epinephrine auto-injector | |
22 | 22 | or medication for respiratory distress may be administered to a | |
23 | 23 | person without a previously established physician-patient | |
24 | 24 | relationship. | |
25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2025. |
