77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a statewide standing order prescribing epinephrine
1010 auto-injectors to public and private schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 38.211, Education Code, is amended by
1313 adding Subsection (b-1) and amending Subsection (c) to read as
1414 follows:
1515 (b-1) The commissioner of state health services or, if the
1616 commissioner is not a physician, the chief medical executive of the
1717 Department of State Health Services may issue a statewide standing
1818 order prescribing epinephrine auto-injectors to a school district,
1919 open-enrollment charter school, or private school.
2020 (c) The standing order under Subsection (b) or (b-1) is not
2121 required to be patient-specific, and the epinephrine auto-injector
2222 or medication for respiratory distress may be administered to a
2323 person without a previously established physician-patient
2424 relationship.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2025.
