88 AN ACT
99 relating to the statute of limitations for sexual assault and
1010 aggravated sexual assault.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 12.01, Code of Criminal Procedure, as
1313 amended by Chapters 93 (S.B. 1527), 118 (H.B. 467), 127 (H.B. 1207),
1414 422 (H.B. 1769), 520 (H.B. 3025), 689 (H.B. 1506), 704 (H.B. 2019),
1515 709 (H.B. 2190), 768 (H.B. 4595), 830 (H.B. 2187), 885 (H.B. 4635),
1616 and 1041 (S.B. 129), Acts of the 88th Legislature, Regular Session,
1717 2023, is reenacted and amended to read as follows:
1818 Art. 12.01. FELONIES. Except as provided in Articles
1919 12.015 and 12.03, felony indictments may be presented within these
2020 limits, and not afterward:
2121 (1) no limitation:
2222 (A) murder and manslaughter;
2323 (B) sexual assault under Section 22.011
2424 [22.011(a)(2)], Penal Code, or aggravated sexual assault under
2525 Section 22.021 [22.021(a)(1)(B)], Penal Code;
2626 (C) [sexual assault, if:
2727 [(i) during the investigation of the
2828 offense biological matter is collected and the matter:
2929 [(a) has not yet been subjected to
3030 forensic DNA testing; or
3131 [(b) has been subjected to forensic
3232 DNA testing and the testing results show that the matter does not
3333 match the victim or any other person whose identity is readily
3434 ascertained; or
3535 [(ii) probable cause exists to believe that
3636 the defendant has committed the same or a similar sex offense
3737 against five or more victims;
3838 [(D)] continuous sexual abuse of young child or
3939 disabled individual under Section 21.02, Penal Code;
4040 (D) [(E)] indecency with a child under Section
4141 21.11, Penal Code;
4242 (E) [(F)] an offense involving leaving the scene
4343 of a collision under Section 550.021, Transportation Code, if the
4444 collision resulted in the death of a person;
4545 (F) [(G)] trafficking of persons under Section
4646 20A.02(a)(7) or (8), Penal Code;
4747 (G) [(H)] continuous trafficking of persons
4848 under Section 20A.03, Penal Code;
4949 (H) [(I)] compelling prostitution under Section
5050 43.05(a)(2) or (3), Penal Code; [or]
5151 (I) [(J)] tampering with physical evidence under
5252 Section 37.09(a)(1) or (d)(1), Penal Code, if:
5353 (i) the evidence tampered with is a human
5454 corpse, as defined by that section; or
5555 (ii) the investigation of the offense shows
5656 that a reasonable person in the position of the defendant at the
5757 time of the commission of the offense would have cause to believe
5858 that the evidence tampered with is related to a criminal homicide
5959 under Chapter 19, Penal Code;
6060 (J) interference with child custody under
6161 Section 25.03(a)(3), Penal Code; or
6262 (K) [(J)] burglary under Section 30.02, Penal
6363 Code, if:
6464 (i) the offense is punishable under
6565 Subsection (d) of that section because the defendant entered a
6666 habitation with the intent to commit an offense under Section
6767 22.011 or 22.021, Penal Code; and
6868 (ii) during the investigation of the
6969 offense biological matter is collected and the matter:
7070 (a) has not yet been subjected to
7171 forensic DNA testing; or
7272 (b) has been subjected to forensic DNA
7373 testing and the testing results show that the matter does not match
7474 the victim or any other person whose identity is readily
7575 ascertained;
7676 (2) ten years from the date of the commission of the
7777 offense:
7878 (A) theft of any estate, real, personal or mixed,
7979 by an executor, administrator, guardian or trustee, with intent to
8080 defraud any creditor, heir, legatee, ward, distributee,
8181 beneficiary or settlor of a trust interested in such estate;
8282 (B) theft by a public servant of government
8383 property over which the public servant exercises control in the
8484 public servant's official capacity;
8585 (C) forgery or the uttering, using, or passing of
8686 forged instruments;
8787 (D) injury to an elderly or disabled individual
8888 punishable as a felony of the first degree under Section 22.04,
8989 Penal Code;
9090 (E) [sexual assault, except as provided by
9191 Subdivision (1) or (8);
9292 [(F)] arson;
9393 (F) [(G)] trafficking of persons under Section
9494 20A.02(a)(1), (2), (3), or (4), Penal Code; or
9595 (G) [(H)] compelling prostitution under Section
9696 43.05(a)(1), Penal Code;
9797 (3) seven years from the date of the commission of the
9898 offense:
9999 (A) misapplication of fiduciary property or
100100 property of a financial institution;
101101 (B) fraudulent securing of document execution;
102102 (C) a felony violation under Chapter 162, Tax
103103 Code;
104104 (D) false statement to obtain property or credit
105105 under Section 32.32, Penal Code;
106106 (E) money laundering;
107107 (F) credit card or debit card abuse under Section
108108 32.31, Penal Code;
109109 (G) fraudulent use or possession of identifying
110110 information under Section 32.51, Penal Code;
111111 (H) exploitation of a child, elderly individual,
112112 or disabled individual under Section 32.53, Penal Code;
113113 (I) health care fraud under Section 35A.02, Penal
114114 Code;
115115 (J) bigamy under Section 25.01, Penal Code,
116116 except as provided by Subdivision (7); or
117117 (K) possession or promotion of child pornography
118118 under Section 43.26, Penal Code;
119119 (4) five years from the date of the commission of the
120120 offense:
121121 (A) theft or robbery;
122122 (B) except as provided by Subdivision (5),
123123 kidnapping;
124124 (C) [(B-1)] except as provided by Subdivision
125125 (1) or (5), burglary;
126126 (D) [(C)] injury to an elderly or disabled
127127 individual that is not punishable as a felony of the first degree
128128 under Section 22.04, Penal Code;
129129 (E) [(D)] abandoning or endangering an [a
130130 child,] elderly [individual,] or disabled individual;
131131 (F) [(E)] insurance fraud;
132132 (G) [(F)] assault under Section 22.01, Penal
133133 Code, if the assault was committed against a person whose
134134 relationship to or association with the defendant is described by
135135 Section 71.0021(b), 71.003, or 71.005, Family Code;
136136 (H) [(G)] continuous violence against the family
137137 under Section 25.11, Penal Code; or
138138 (I) [(H)] aggravated assault under Section
139139 22.02, Penal Code;
140140 (5) if the investigation of the offense shows that the
141141 victim is younger than 17 years of age at the time the offense is
142142 committed, 20 years from the 18th birthday of the victim of one of
143143 the following offenses:
144144 (A) kidnapping under Section 20.03, Penal Code,
145145 or aggravated kidnapping under Section 20.04, Penal Code; or
146146 (B) subject to Subdivision (1)(K) [(1)(J)],
147147 burglary under Section 30.02, Penal Code, if the offense is
148148 punishable under Subsection (d) of that section because the
149149 defendant entered a habitation with the intent to commit an offense
150150 described by Subdivision (1)(B) or (C) [(D)] of this article or
151151 Paragraph (A) of this subdivision;
152152 (6) 20 years from the 18th birthday of the victim of
153153 one of the following offenses:
154154 (A) trafficking of a child [persons] under
155155 Section 20A.02(a)(5) or (6), Penal Code; or
156156 (B) sexual performance by a child under Section
157157 43.25, Penal Code;
158158 (7) ten years from the 18th birthday of the victim of
159159 the offense:
160160 (A) injury to a child under Section 22.04, Penal
161161 Code;
162162 (B) bigamy under Section 25.01, Penal Code, if
163163 the investigation of the offense shows that the person, other than
164164 the legal spouse of the defendant, whom the defendant marries or
165165 purports to marry or with whom the defendant lives under the
166166 appearance of being married is younger than 18 years of age at the
167167 time the offense is committed; or
168168 (C) [(D)] abandoning or endangering a child;
169169 (8) [(7)] ten years from the date the offense was
170170 discovered: trafficking of a disabled individual under Section
171171 20A.02(a)(5) or (6), Penal Code;
172172 [(8) two years from the date the offense was
173173 discovered: sexual assault punishable as a state jail felony under
174174 Section 22.011(f)(2), Penal Code;] or
175175 (9) three years from the date of the commission of the
176176 offense: all other felonies.
177177 SECTION 2. The change in law made by this Act does not apply
178178 to an offense if the prosecution of that offense becomes barred by
179179 limitation before the effective date of this Act. The prosecution
180180 of that offense remains barred as if this Act had not taken effect.
181181 SECTION 3. This Act takes effect September 1, 2025.
