77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a pharmacist to determine whether to
1010 administer a vaccine, including a COVID-19 vaccine.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 551.006, Occupations Code, is amended to
1313 read as follows:
1414 Sec. 551.006. EXCLUSIVE AUTHORITY. Notwithstanding any
1515 other law, a pharmacist has the exclusive authority to determine
1616 whether or not to:
1717 (1) dispense a drug; or
1818 (2) administer a vaccine, including a COVID-19
1919 vaccine.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2025.
