77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the criteria considered by groundwater conservation
1010 districts before granting or denying a permit or permit amendment.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 36.113(d), Water Code, is amended to
1313 read as follows:
1414 (d) This subsection does not apply to the renewal of an
1515 operating permit issued under Section 36.1145. Before granting or
1616 denying a permit, or a permit amendment issued in accordance with
1717 Section 36.1146, the district shall consider whether:
1818 (1) the application conforms to the requirements
1919 prescribed by this chapter and is accompanied by the prescribed
2020 fees;
2121 (2) the proposed use of water unreasonably affects:
2222 (A) existing groundwater and surface water
2323 resources; [or]
2424 (B) existing permit holders; or
2525 (C) wells that are registered with the district
2626 and exempt from the requirement to obtain a permit under this
2727 chapter or district rules;
2828 (3) the proposed use of water is dedicated to any
2929 beneficial use;
3030 (4) the proposed use of water is consistent with the
3131 district's approved management plan;
3232 (5) if the well will be located in the Hill Country
3333 Priority Groundwater Management Area, the proposed use of water
3434 from the well is wholly or partly to provide water to a pond, lake,
3535 or reservoir to enhance the appearance of the landscape;
3636 (6) the applicant has agreed to avoid waste and
3737 achieve water conservation; and
3838 (7) the applicant has agreed that reasonable diligence
3939 will be used to protect groundwater quality and that the applicant
4040 will follow well plugging guidelines at the time of well closure.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2025.
