77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to supplemental pay for members of the Texas military
1010 forces suffering an economic hardship as a result of serving on
1111 military duty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 437.220(a), (b), and (c), Government
1414 Code, are amended to read as follows:
1515 (a) A person who is called to military duty as a member of
1616 the Texas military forces [National Guard] in the service of this
1717 state or the United States by proper federal or state authority and
1818 who suffers an economic hardship as a result of serving on military
1919 duty is eligible to receive supplemental pay for serving in
2020 accordance with this section. Payment under this subsection is
2121 subject to the availability of funds.
2222 (b) The comptroller shall establish the Texas military
2323 forces [National Guard members'] supplemental military duty pay
2424 account in the general revenue fund. Money in the account may be
2525 appropriated only for purposes of implementing this section. The
2626 comptroller, governor, or adjutant general may accept gifts and
2727 grants for deposit to the credit of the account. The legislature
2828 may transfer money into the account or may appropriate money to
2929 implement this section and the comptroller shall credit that money
3030 to the account.
3131 (c) A member of the Texas military forces [National Guard]
3232 described by Subsection (a) is eligible to receive supplemental pay
3333 under this section in an amount not to exceed the lesser of:
3434 (1) the amount required to alleviate the economic
3535 hardship the member suffers as a result of serving on active duty;
3636 and
3737 (2) the difference between the amount of income that
3838 the member has lost from civilian employment as a result of being
3939 called to military duty and the amount of military pay and
4040 allowances the member receives from state or federal sources while
4141 on military duty.
4242 SECTION 2. The change in law made by this Act applies to
4343 military duty by a member of the Texas military forces occurring on
4444 or after the effective date of this Act regardless of the date the
4545 member was called to military duty. Military duty occurring before
4646 the effective date of this Act is governed by the law in effect on
4747 the date the military duty occurred, and the former law is continued
4848 in effect for that purpose.
4949 SECTION 3. This Act takes effect September 1, 2025.
