88 AN ACT
99 relating to observing standard time year-round and authorizing a
1010 statewide referendum allowing voters to indicate a preference for
1111 observing standard time year-round or observing daylight saving
1212 time year-round.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. (a) Section 312.016, Government Code, is
1515 amended by adding Subsection (d) to read as follows:
1616 (d) The state, acting under the exemption provisions of
1717 Section 3(a), Uniform Time Act of 1966 (15 U.S.C. Section 260a(a)),
1818 is exempt from the provisions of that law that establish daylight
1919 saving time. The exemption provided by this subsection applies to
2020 both the portion of the state using central standard time as the
2121 official standard time and the portion of the state using mountain
2222 standard time as the official standard time.
2323 (b) This section takes effect November 3, 2025, to coincide
2424 with the end of daylight saving time for 2025.
2525 SECTION 2. (a) Section 312.016, Government Code, is
2626 amended by adding Subsection (d) to read as follows:
2727 (d) The state, acting as authorized under federal law, shall
2828 observe daylight saving time year-round. This subsection applies
2929 to both the portion of the state using central standard time as the
3030 official standard time and the portion of the state using mountain
3131 standard time as the official standard time.
3232 (b) Section 312.016(d), Government Code, as added by this
3333 section, becomes law only if a majority of the votes cast in the
3434 statewide referendum authorized by Section 3 of this Act are in
3535 favor of "Observing daylight saving time year-round." If a
3636 majority of the votes cast in the statewide referendum authorized
3737 by Section 3 of this Act are not in favor of "Observing daylight
3838 saving time year-round," this section has no effect.
3939 SECTION 3. (a) If the United States Congress enacts
4040 legislation that becomes law that authorizes this state to observe
4141 daylight saving time year-round, a statewide referendum shall be
4242 conducted to allow the voters of this state to indicate a preference
4343 for either:
4444 (1) observing standard time year-round; or
4545 (2) observing daylight saving time year-round.
4646 (b) The ballot for the referendum shall be printed to state
4747 as follows: "Which of the following do you prefer?
4848 "Observing standard time year-round."
4949 "Observing daylight saving time year-round."
5050 (c) The secretary of state shall design the ballot for the
5151 referendum to enable a voter to select either of the statements set
5252 out in Subsection (b) of this section as the voter's preference.
5353 (d) The proposition for the referendum shall be printed on
5454 the ballot under the heading: "Referendum Proposition."
5555 (e) Notice of the election shall be given in the same manner
5656 that notice of proposed constitutional amendments is given.
5757 (f) Returns of the votes cast on the proposition shall be
5858 prepared and canvassed in the same manner as the returns on the
5959 proposed constitutional amendments. Immediately after the results
6060 of the election are certified, the secretary of state shall
6161 transmit a copy of the certification to the lieutenant governor and
6262 the speaker of the house of representatives.
6363 (g) Except as provided by Subsection (h) of this section,
6464 the statewide referendum under this section shall be held during
6565 the first general election for state and county officers following
6666 the date the United States Congress enacts legislation that becomes
6767 law that authorizes this state to observe daylight saving time
6868 year-round.
6969 (h) If the date the United States Congress enacts
7070 legislation that becomes law that authorizes this state to observe
7171 daylight saving time year-round is less than 74 days before the date
7272 of the next general election for state and county officers, the
7373 statewide referendum under this section shall be held during the
7474 second general election for state and county officers following the
7575 date the United States Congress enacts legislation that becomes law
7676 that authorizes this state to observe daylight saving time
7777 year-round.
7878 SECTION 4. (a) If the constitutional amendment proposed by
7979 the 89th Legislature, Regular Session, 2025, authorizing the
8080 statewide referendum under Section 3 of this Act is approved by the
8181 voters and if a majority of the votes cast in the statewide
8282 referendum are in favor of "Observing standard time year-round,"
8383 Section 312.016(d), Government Code, as added by this Act, remains
8484 in effect and Section 2 of this Act does not take effect.
8585 (b) If the constitutional amendment proposed by the 89th
8686 Legislature, Regular Session, 2025, authorizing the statewide
8787 referendum under Section 3 of this Act is approved by the voters and
8888 if a majority of the votes cast in the statewide referendum are in
8989 favor of "Observing daylight saving time year-round," Section
9090 312.016(d), Government Code, as added by this Act, is repealed and
9191 Section 2 of this Act takes effect on the date daylight saving time
9292 begins after the statewide referendum under Section 3 of this Act.
9393 SECTION 5. (a) Except as otherwise provided by this Act,
9494 this Act takes effect September 1, 2025.
9595 (b) Sections 2, 3, and 4 of this Act take effect only if the
9696 constitutional amendment proposed by the 89th Legislature, Regular
9797 Session, 2025, authorizing a referendum election on the issue of
9898 daylight saving time is approved by the voters. If that amendment
9999 is not approved by the voters, Sections 2, 3, and 4 of this Act have
100100 no effect.
