77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the county in which an application for court-ordered
1010 mental health services must be filed.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 574.001(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) Except as provided by Subsection (f), the application
1515 must be filed with the county clerk in the county in which the
1616 proposed patient:
1717 (1) resides;
1818 (2) is located at the time the application is filed [is
1919 found]; [or]
2020 (3) was apprehended under Chapter 573; or
2121 (4) is receiving mental health services by court order
2222 or under Subchapter A, Chapter 573.
2323 SECTION 2. The change in law made by this Act to Section
2424 574.001, Health and Safety Code, applies only to an application for
2525 court-ordered mental health services submitted on or after the
2626 effective date of this Act.
2727 SECTION 3. This Act takes effect September 1, 2025.
