10 | 10 | mental health services must be filed. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 574.001(b), Health and Safety Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (b) Except as provided by Subsection (f), the application | |
15 | 15 | must be filed with the county clerk in the county in which the | |
16 | 16 | proposed patient: | |
17 | 17 | (1) resides; | |
18 | 18 | (2) is located at the time the application is filed [is | |
19 | 19 | found]; [or] | |
20 | 20 | (3) was apprehended under Chapter 573; or | |
21 | 21 | (4) is receiving mental health services by court order | |
22 | 22 | or under Subchapter A, Chapter 573. | |
23 | 23 | SECTION 2. The change in law made by this Act to Section | |
24 | 24 | 574.001, Health and Safety Code, applies only to an application for | |
25 | 25 | court-ordered mental health services submitted on or after the | |
26 | 26 | effective date of this Act. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
