88 AN ACT
99 relating to prohibited student athlete name, image, and likeness
1010 agreements; providing injunctive relief and a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 13, Occupations Code, is
1313 amended by adding Chapter 2053 to read as follows:
1414 CHAPTER 2053. NAME, IMAGE, AND LIKENESS AGREEMENTS
1515 Sec. 2053.001. DEFINITION. In this chapter, "student
1616 athlete" means an individual who as a student participates in:
1717 (1) a University Interscholastic League activity; or
1818 (2) an intercollegiate athletic program at an
1919 institution of higher education.
2020 Sec. 2053.002. PROHIBITED NAME, IMAGE, AND LIKENESS
2121 AGREEMENTS. A person may not enter into an agreement with a student
2222 athlete under which the person:
2323 (1) pays the student athlete an amount as
2424 consideration;
2525 (2) receives the exclusive right to negotiate the use
2626 or sale of the student athlete's name, image, and likeness for the
2727 term of the agreement; and
2828 (3) is entitled to receive a percentage of earnings
2929 from the use or sale of the student athlete's name, image, and
3030 likeness until the earlier of:
3131 (A) the date the person has received a
3232 predetermined amount of the student athlete's earnings; or
3333 (B) the date the agreement expires.
3434 Sec. 2053.003. PROHIBITED AGREEMENTS VOID AND
3535 UNENFORCEABLE. An agreement entered into in violation of Section
3636 2053.002 or any language in an agreement that circumvents the
3737 prohibition imposed under that section or otherwise achieves the
3838 same or a substantially similar effect as a prohibited agreement is
3939 void and unenforceable.
4040 Sec. 2053.004. PROHIBITED WAIVER. An agreement may not
4141 waive the requirements of this chapter. A purported waiver of this
4242 chapter is a violation of this section and is void.
4343 Sec. 2053.005. CIVIL PENALTY; INJUNCTIVE RELIEF. (a) A
4444 person who violates this chapter is liable for a civil penalty not
4545 to exceed $100,000 for each violation.
4646 (b) The attorney general may bring an action in the name of
4747 this state to:
4848 (1) recover a civil penalty under Subsection (a);
4949 (2) restrain or enjoin the person from violating this
5050 chapter; or
5151 (3) recover the civil penalty under Subsection (a) and
5252 seek injunctive relief.
5353 (c) The attorney general may recover reasonable attorney's
5454 fees and court costs in bringing an action under this section.
5555 SECTION 2. Chapter 2053, Occupations Code, as added by this
5656 Act, applies only to an agreement entered into on or after the
5757 effective date of this Act.
5858 SECTION 3. This Act takes effect September 1, 2025.
