---|
9 | 9 | | relating to itemized billing for health care services and supplies |
---|
10 | 10 | | provided by health care providers. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 185.001(2), Health and Safety Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (2) "Health care provider" means an individual or [a] |
---|
15 | 15 | | facility licensed, certified, or otherwise authorized to provide |
---|
16 | 16 | | health care services or supplies in this state in the ordinary |
---|
17 | 17 | | course of business, including a physician, nurse practitioner, |
---|
18 | 18 | | physician assistant, or hospital [, except the term does not |
---|
19 | 19 | | include a federally-qualified health center, as defined by 42 |
---|
20 | 20 | | U.S.C. Section 1396d(l)(2)(B)]. |
---|
21 | 21 | | SECTION 2. Section 185.002, Health and Safety Code, is |
---|
22 | 22 | | amended by amending Subsections (c) and (d) and adding Subsection |
---|
23 | 23 | | (c-1) to read as follows: |
---|
24 | 24 | | (c) Except as provided by Subsection (c-1), a [A] health |
---|
25 | 25 | | care provider may issue the itemized bill: |
---|
26 | 26 | | (1) electronically, including through a patient |
---|
27 | 27 | | portal on the provider's Internet website; |
---|
28 | 28 | | (2) through a hard copy delivered by mail or a common |
---|
29 | 29 | | carrier; or |
---|
30 | 30 | | (3) through a hard copy the patient or the patient's |
---|
31 | 31 | | designee obtains at the provider's place of business. |
---|
32 | 32 | | (c-1) A health care provider that issues an itemized bill to |
---|
33 | 33 | | a patient electronically through a patient portal under Subsection |
---|
34 | 34 | | (c)(1) shall: |
---|
35 | 35 | | (1) determine whether the patient has created a |
---|
36 | 36 | | patient profile on the portal; and |
---|
37 | 37 | | (2) if the health care provider determines that the |
---|
38 | 38 | | patient has not created a patient profile, mail a copy of the |
---|
39 | 39 | | itemized bill to the patient as described by Subsection (c)(2). |
---|
40 | 40 | | (d) A patient is entitled to obtain from the health care |
---|
41 | 41 | | provider an itemized bill: |
---|
42 | 42 | | (1) on request at any time after the itemized bill is |
---|
43 | 43 | | initially issued under Subsection (a); and |
---|
44 | 44 | | (2) through the patient's chosen method of issuance in |
---|
45 | 45 | | accordance with Subsection (c). |
---|
46 | 46 | | SECTION 3. Section 185.003, Health and Safety Code, is |
---|
47 | 47 | | amended to read as follows: |
---|
48 | 48 | | Sec. 185.003. DISCIPLINARY ACTION BY LICENSING |
---|
49 | 49 | | AUTHORITY. The appropriate licensing authority shall take |
---|
50 | 50 | | disciplinary action against a health care [the] provider that |
---|
51 | 51 | | violates this chapter [for the violation] as if the provider |
---|
52 | 52 | | violated an applicable licensing law. |
---|
53 | 53 | | SECTION 4. Notwithstanding Section 185.001, Health and |
---|
54 | 54 | | Safety Code, as amended by this Act, a health care provider, as |
---|
55 | 55 | | defined by that section, that was not subject to the requirements of |
---|
56 | 56 | | Chapter 185, Health and Safety Code, before the effective date of |
---|
57 | 57 | | this Act is not required to comply with the requirements of that |
---|
58 | 58 | | chapter before January 1, 2026. |
---|
59 | 59 | | SECTION 5. Section 185.002, Health and Safety Code, as |
---|
60 | 60 | | amended by this Act, applies only to an itemized bill issued on or |
---|
61 | 61 | | after the effective date of this Act. An itemized bill issued before |
---|
62 | 62 | | the effective date of this Act is governed by the law in effect on |
---|
63 | 63 | | the date the itemized bill was issued, and the former law is |
---|
64 | 64 | | continued in effect for that purpose. |
---|
65 | 65 | | SECTION 6. This Act takes effect September 1, 2025. |
