77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to itemized billing for health care services and supplies
1010 provided by health care providers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 185.001(2), Health and Safety Code, is
1313 amended to read as follows:
1414 (2) "Health care provider" means an individual or [a]
1515 facility licensed, certified, or otherwise authorized to provide
1616 health care services or supplies in this state in the ordinary
1717 course of business, including a physician, nurse practitioner,
1818 physician assistant, or hospital [, except the term does not
1919 include a federally-qualified health center, as defined by 42
2020 U.S.C. Section 1396d(l)(2)(B)].
2121 SECTION 2. Section 185.002, Health and Safety Code, is
2222 amended by amending Subsections (c) and (d) and adding Subsection
2323 (c-1) to read as follows:
2424 (c) Except as provided by Subsection (c-1), a [A] health
2525 care provider may issue the itemized bill:
2626 (1) electronically, including through a patient
2727 portal on the provider's Internet website;
2828 (2) through a hard copy delivered by mail or a common
2929 carrier; or
3030 (3) through a hard copy the patient or the patient's
3131 designee obtains at the provider's place of business.
3232 (c-1) A health care provider that issues an itemized bill to
3333 a patient electronically through a patient portal under Subsection
3434 (c)(1) shall:
3535 (1) determine whether the patient has created a
3636 patient profile on the portal; and
3737 (2) if the health care provider determines that the
3838 patient has not created a patient profile, mail a copy of the
3939 itemized bill to the patient as described by Subsection (c)(2).
4040 (d) A patient is entitled to obtain from the health care
4141 provider an itemized bill:
4242 (1) on request at any time after the itemized bill is
4343 initially issued under Subsection (a); and
4444 (2) through the patient's chosen method of issuance in
4545 accordance with Subsection (c).
4646 SECTION 3. Section 185.003, Health and Safety Code, is
4747 amended to read as follows:
4848 Sec. 185.003. DISCIPLINARY ACTION BY LICENSING
4949 AUTHORITY. The appropriate licensing authority shall take
5050 disciplinary action against a health care [the] provider that
5151 violates this chapter [for the violation] as if the provider
5252 violated an applicable licensing law.
5353 SECTION 4. Notwithstanding Section 185.001, Health and
5454 Safety Code, as amended by this Act, a health care provider, as
5555 defined by that section, that was not subject to the requirements of
5656 Chapter 185, Health and Safety Code, before the effective date of
5757 this Act is not required to comply with the requirements of that
5858 chapter before January 1, 2026.
5959 SECTION 5. Section 185.002, Health and Safety Code, as
6060 amended by this Act, applies only to an itemized bill issued on or
6161 after the effective date of this Act. An itemized bill issued before
6262 the effective date of this Act is governed by the law in effect on
6363 the date the itemized bill was issued, and the former law is
6464 continued in effect for that purpose.
6565 SECTION 6. This Act takes effect September 1, 2025.
