88 AN ACT
99 relating to the registration of firearms; creating a criminal
1010 offense; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 411, Government Code, is amended by
1313 adding Subchapter H-1 to read as follows:
1414 SUBCHAPTER H-1. REGISTRATION OF FIREARMS
1515 Sec. 411.221. DEFINITION. In this subchapter, "firearm"
1616 has the meaning assigned by Section 46.01, Penal Code.
1717 Sec. 411.222. RULEMAKING AUTHORITY; ADMINISTRATION. (a)
1818 The commission shall adopt rules necessary to implement this
1919 subchapter.
2020 (b) The department shall:
2121 (1) administer this subchapter and the rules adopted
2222 by the director under this subchapter; and
2323 (2) take action necessary to ensure compliance with
2424 this subchapter.
2525 Sec. 411.223. REGISTRATION REQUIREMENTS. (a) This
2626 subchapter applies to a person who:
2727 (1) is a resident of this state and who on or after
2828 January 1, 2026, acquires a firearm for the purpose of possessing
2929 the firearm in this state; or
3030 (2) enters this state on or after January 1, 2026, for
3131 the purpose of residing in this state and who possesses a firearm,
3232 regardless of when the person acquired the firearm.
3333 (b) A person to whom this subchapter applies shall submit an
3434 application for a certificate of registration for a firearm with
3535 the department on a form prescribed by the department that includes
3636 the information described by Subsection (c) not later than the 30th
3737 day after the date the person:
3838 (1) acquires the firearm, if the person is described
3939 by Subsection (a)(1); or
4040 (2) enters this state with the firearm, if the person
4141 is described by Subsection (a)(2).
4242 (c) The application must include:
4343 (1) the owner's:
4444 (A) full name and place and date of birth;
4545 (B) residence and business addresses; and
4646 (C) driver's license number or identification
4747 certificate number issued by the department, or if the owner is a
4848 new resident of this state, information necessary to prove identity
4949 to the satisfaction of the department;
5050 (2) the name of the manufacturer of the firearm;
5151 (3) the model, type of action, caliber or gauge, and
5252 serial number of the firearm; and
5353 (4) the source from which the firearm was obtained,
5454 including the previous owner's name and address.
5555 (d) An application for a certificate of registration must be
5656 accompanied by the required registration fee.
5757 Sec. 411.224. REGISTRATION FEE. The department shall
5858 charge for issuance of a certificate of registration a reasonable
5959 fee in the amount necessary to cover the costs of administering this
6060 subchapter.
6161 Sec. 411.225. CHANGE OF INFORMATION. If the information
6262 provided to the department in connection with a certificate of
6363 registration changes, the certificate holder shall notify the
6464 department in the form and manner prescribed by the department not
6565 later than the 30th day after the date the change occurs.
6666 Sec. 411.226. CRIMINAL OFFENSE. (a) A person commits an
6767 offense if the person fails to register a firearm in violation of
6868 this subchapter.
6969 (b) An offense under Subsection (a) is a Class C
7070 misdemeanor.
7171 SECTION 2. Not later than December 1, 2025:
7272 (1) the public safety director of the Department of
7373 Public Safety of the State of Texas shall adopt the rules necessary
7474 to implement Subchapter H-1, Chapter 411, Government Code, as added
7575 by this Act; and
7676 (2) the department shall create the application form
7777 and the change of information form required by Subchapter H-1,
7878 Chapter 411, Government Code, as added by this Act.
7979 SECTION 3. (a) Except as provided by Subsection (b) of this
8080 section, this Act takes effect September 1, 2025.
8181 (b) Section 411.226, Government Code, as added by this Act,
8282 takes effect January 1, 2026.
