77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a property owners' association to
1010 regulate the assembly, association, and speech of property owners
1111 or residents.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 202, Property Code, is amended by adding
1414 Section 202.013 to read as follows:
1515 Sec. 202.013. REGULATION OF ASSEMBLY, ASSOCIATION, AND
1616 SPEECH. (a) Except as otherwise provided by this section, a
1717 property owners' association may not adopt or enforce a provision
1818 in a dedicatory instrument that:
1919 (1) prohibits, restricts, or has the effect of
2020 prohibiting or restricting a property owner or resident from:
2121 (A) peacefully assembling or meeting with
2222 property owners' association members, residents, or their invitees
2323 or guests at property owned or maintained by the property owners'
2424 association or owned in common by the property owners' association
2525 members; or
2626 (B) inviting guest speakers, including public
2727 officials and candidates for public office, without prior approval
2828 by the property owners' association to address or meet with
2929 property owners' association members, residents, or their invitees
3030 or guests; or
3131 (2) regulates, restricts, or has the effect of
3232 regulating or restricting the content of a property owner's or
3333 resident's speech.
3434 (b) This section does not prohibit the enforcement or
3535 adoption of a provision in a dedicatory instrument that, to the
3636 extent allowed by the constitutions of this state and the United
3737 States, prohibits speech or conduct that:
3838 (1) threatens the public health or safety;
3939 (2) violates a law; or
4040 (3) contains language, graphics, or any display that
4141 is patently offensive to a passerby.
4242 SECTION 2. This Act takes effect September 1, 2025.
