8	8	AN ACT
9	9	relating to the additional compensation certain counties pay to
10	10	judges and justices for extrajudicial services.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Chapter 25A, Government Code, is amended by
13	13	adding Section 25A.0115 to read as follows:
14	14	Sec. 25A.0115. AUTHORITY FOR ADDITIONAL COMPENSATION. (a)
15	15	The commissioners court of a county may pay the judges of the
16	16	business court having jurisdiction in the county additional
17	17	compensation in an amount not to exceed the limitations provided in
18	18	Section 659.012 for extrajudicial services performed by the
19	19	business court judges.
20	20	(b) The county shall pay the compensation from the county
21	21	general fund or other available county funds in:
22	22	(1) monthly installments; or
23	23	(2) biweekly installments if authorized by the
24	24	commissioners court.
25	25	(c) The compensation is in addition to the salary paid by
26	26	this state and any other compensation authorized by law.
27	27	SECTION 2. Section 31.001, Government Code, is amended to
28	28	read as follows:
29	29	Sec. 31.001. AUTHORITY FOR COUNTY PAYMENT OF COMPENSATION.
30	30	The commissioners courts in the counties of each of the 15 courts of
31	31	appeals districts may pay additional compensation in an amount that
32	32	does not exceed the limitations of Section 659.012 to each of the
33	33	justices of the courts of appeals[, other than a justice of the
34	34	Court of Appeals of the Fifteenth Court of Appeals District,]
35	35	residing within the court of appeals district that includes those
36	36	counties. The compensation is for all extrajudicial services
37	37	performed by the justices.
38	38	SECTION 3. Section 659.012(a), Government Code, is amended
39	39	to read as follows:
40	40	(a) Notwithstanding Section 659.011 and subject to
41	41	Subsections (b) and (b-1):
42	42	(1) a judge of a district court or a division of the
43	43	business court is entitled to an annual base salary from the state
44	44	as set by the General Appropriations Act in an amount equal to at
45	45	least $140,000, except that the combined base salary of a district
46	46	judge or judge of a division of the business court from all state
47	47	and county sources, including compensation for any extrajudicial
48	48	services performed on behalf of the county, may not exceed the
49	49	amount that is $5,000 less than the maximum combined base salary
50	50	from all state and county sources for a justice of a court of
51	51	appeals other than a chief justice as determined under this
52	52	subsection;
53	53	(2) [except as provided by Subdivision (3),] a justice
54	54	of a court of appeals other than the chief justice is entitled to an
55	55	annual base salary from the state in the amount equal to 110 percent
56	56	of the state base salary of a district judge as set by the General
57	57	Appropriations Act, except that the combined base salary of a
58	58	justice of the court of appeals other than the chief justice from
59	59	all state and county sources, including compensation for any
60	60	extrajudicial services performed on behalf of the county, may not
61	61	exceed the amount that is $13,000 more [$5,000 less] than the base
62	62	salary for a justice of the supreme court as determined under this
63	63	subsection;
64	64	(3) [a justice of the Court of Appeals for the
65	65	Fifteenth Court of Appeals District other than the chief justice is
66	66	entitled to an annual base salary from the state in the amount equal
67	67	to $5,000 less than 120 percent of the state base salary of a
68	68	district judge as set by the General Appropriations Act;
69	69	[(4)] a justice of the supreme court other than the
70	70	chief justice or a judge of the court of criminal appeals other than
71	71	the presiding judge is entitled to an annual base salary from the
72	72	state in the amount equal to 120 percent of the state base salary of
73	73	a district judge as set by the General Appropriations Act; and
74	74	(4) [(5)] the chief justice or presiding judge of an
75	75	appellate court is entitled to an annual base salary from the state
76	76	in the amount equal to $2,500 more than the state base salary
77	77	provided for the other justices or judges of the court, except that
78	78	the combined base salary of the chief justice of a court of appeals
79	79	from all state and county sources may not exceed the amount equal to
80	80	$15,500 more [$2,500 less] than the base salary for a justice of the
81	81	supreme court as determined under this subsection.
82	82	SECTION 4. The changes in law made by this Act apply
83	83	beginning with the state fiscal biennium beginning September 1,
84	84	2025.
85	85	SECTION 5. This Act takes effect September 1, 2025.
