77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study regarding available beds at inpatient mental
1010 health facilities providing acute psychiatric treatment.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this section, "commission" means the
1313 Health and Human Services Commission.
1414 (b) The commission shall conduct a study regarding the
1515 availability of beds at inpatient mental health facilities in this
1616 state that provide acute inpatient psychiatric treatment. The
1717 study must evaluate:
1818 (1) the current number of psychiatric beds available
1919 at inpatient mental health facilities in this state that provide
2020 inpatient psychiatric treatment to individuals experiencing an
2121 acute mental health crisis, including a breakdown of beds available
2222 for patients:
2323 (A) committed to a facility for competency
2424 restoration services under Chapter 46B, Code of Criminal Procedure;
2525 (B) civilly committed to a facility under Chapter
2626 841, Health and Safety Code;
2727 (C) committed to a facility after having been
2828 found not guilty by reason of insanity under Chapter 46C, Code of
2929 Criminal Procedure;
3030 (D) voluntarily admitted to a facility;
3131 (E) 18 years of age or older;
3232 (F) younger than 18 years of age;
3333 (G) receiving long-term mental health treatment
3434 in a facility; and
3535 (H) who have been diagnosed with an intellectual
3636 or developmental disability;
3737 (2) the current number of patients admitted to an
3838 inpatient mental health facility in this state that provides
3939 inpatient psychiatric treatment to individuals experiencing an
4040 acute mental health crisis, including a breakdown of:
4141 (A) the number of patients committed to a
4242 facility for competency restoration services under Chapter 46B,
4343 Code of Criminal Procedure, including the number of individuals
4444 committed under an initial order of commitment or an order
4545 extending the initial restoration period;
4646 (B) the number of patients civilly committed to a
4747 facility under Chapter 841, Health and Safety Code;
4848 (C) the number of patients committed to a
4949 facility after having been found not guilty by reason of insanity
5050 under Chapter 46C, Code of Criminal Procedure;
5151 (D) the number of patients voluntarily admitted
5252 to a facility;
5353 (E) the number of patients 18 years of age or
5454 older;
5555 (F) the number of patients younger than 18 years
5656 of age;
5757 (G) the percentage of patients in this state who
5858 will likely require long-term mental health treatment in a
5959 facility; and
6060 (H) the number of patients who have been
6161 diagnosed with an intellectual or developmental disability;
6262 (3) the projected need over the next several years for
6363 additional psychiatric beds at inpatient mental health facilities
6464 that provide inpatient psychiatric treatment to individuals
6565 experiencing an acute mental health crisis, including the projected
6666 percentage of incoming patients who will likely require long-term
6767 mental health treatment in a facility; and
6868 (4) current and anticipated resources, including
6969 workforce needs, necessary to meet the demands described by
7070 Subdivisions (1), (2), and (3) of this subsection.
7171 (c) In designing and conducting the study, the commission
7272 may collaborate with institutions of higher education in this state
7373 that award medical degrees.
7474 (d) Not later than September 1, 2026, the commission shall
7575 prepare and submit to the legislature a written report containing
7676 the results of the study and any recommendations for legislative or
7777 other action.
7878 SECTION 2. This Act expires September 1, 2027.
7979 SECTION 3. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2025.
