88 AN ACT
99 relating to the prohibition of lane restrictions on a portion of
1010 Interstate Highway 635.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter E, Chapter 228,
1313 Transportation Code, is amended to read as follows:
1414 SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL
1515 COLLECTION, LANE RESTRICTIONS, AND[;] CONVERSION OF NONTOLLED
1616 STATE HIGHWAY
1717 SECTION 2. Subchapter E, Chapter 228, Transportation Code,
1818 is amended by adding Section 228.208 to read as follows:
1919 Sec. 228.208. LANE RESTRICTIONS ON PORTION OF INTERSTATE
2020 HIGHWAY 635 PROHIBITED. Notwithstanding any other provision of
2121 this subtitle, the department may not place a lane restriction,
2222 including charging a toll or implementing managed lanes, either
2323 directly or indirectly through an agreement with another entity, on
2424 the portion of Interstate Highway 635 between its intersection with
2525 Interstate Highway 30 and its intersection with U.S. Highway 75.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2025.
