99 relating to a mobile stroke unit grant program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 773, Health and Safety Code, is amended
1212 by adding Subchapter H-1 to read as follows:
1313 SUBCHAPTER H-1. MOBILE STROKE UNIT GRANT PROGRAM
1414 Sec. 773.221. DEFINITIONS. In this subchapter:
1515 (1) "Commission" means the Health and Human Services
1616 Commission.
1717 (2) "Grant program" means the mobile stroke unit grant
1818 program established under this subchapter.
1919 (3) "Mobile stroke unit" means a specialized emergency
2020 medical services vehicle that:
2121 (A) is equipped with a mobile computed tomography
2222 scanner and other necessary medical equipment and medications for
2323 diagnosing and treating an individual who suffers a stroke;
2424 (B) is staffed with personnel trained to diagnose
2525 and provide acute stroke treatment to an individual outside of a
2626 hospital setting; and
2727 (C) has a neurologist on board the vehicle or
2828 available for consultation with the vehicle's personnel through a
2929 telemedicine medical service, as defined by Section 111.001,
3030 Occupations Code.
3131 (4) "Stroke facility" has the meaning assigned by
3232 Section 773.202.
3333 Sec. 773.222. ESTABLISHMENT AND ADMINISTRATION OF GRANT
3434 PROGRAM. The executive commissioner by rule shall establish and
3535 the commission shall administer a mobile stroke unit grant program
3636 to improve health care outcomes for individuals who suffer a stroke
3737 by providing financial assistance to stroke facilities and
3838 increasing the availability of mobile stroke units in this state.
3939 Sec. 773.223. APPLICATION. A stroke facility that holds a
4040 comprehensive (Level 1) stroke designation from the department may
4141 apply to the commission for a grant award under the grant program.
4242 Sec. 773.224. AWARD OF GRANTS. (a) The executive
4343 commissioner by rule shall establish eligibility criteria and a
4444 scoring system for the commission to award grants under the
4545 program.
4646 (b) The commission may award grants under the program to
4747 eligible applicants.
4848 (c) The commission may only award a grant in accordance with
4949 a contract between the commission and a grant recipient that
5050 includes conditions providing the commission with sufficient
5151 control to ensure the public purpose of improving public health is
5252 accomplished and the state receives a return benefit.
5353 Sec. 773.225. USE OF GRANT MONEY. A grant recipient may use
5454 money awarded under the grant program only for the recipient's
5555 capital costs associated with procuring equipment necessary to
5656 operate a mobile stroke unit, including:
5757 (1) a specialized emergency medical services vehicle;
5858 (2) a mobile computed tomography scanner;
5959 (3) medical equipment used in diagnosing or treating
6060 an individual who suffers a stroke; and
6161 (4) any other equipment the commission considers
6262 necessary or appropriate.
6363 Sec. 773.226. GRANT RECIPIENT REPORTING REQUIREMENT. A
6464 grant recipient shall annually submit to the commission a report on
6565 the recipient's use of grant money, including:
6666 (1) the health outcomes of individuals treated by the
6767 recipient's mobile stroke units; and
6868 (2) the recipient's operating expenses associated with
6969 operating mobile stroke units.
7070 Sec. 773.227. FUNDING. The commission shall award grants
7171 as provided by this subchapter from available money and any
7272 additional money appropriated for purposes of this subchapter.
7373 Sec. 773.228. GIFTS, GRANTS, AND DONATIONS. The commission
7474 may accept gifts, grants, and donations from any source that are
7575 made for the purposes of the grant program.
7676 SECTION 2. Not later than January 1, 2026, the executive
7777 commissioner of the Health and Human Services Commission shall
7878 adopt the rules necessary to implement Subchapter H-1, Chapter 773,
7979 Health and Safety Code, as added by this Act.
8080 SECTION 3. This Act takes effect September 1, 2025.
