| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 773, Health and Safety Code, is amended |
|---|
| 12 | 12 | | by adding Subchapter H-1 to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER H-1. MOBILE STROKE UNIT GRANT PROGRAM |
|---|
| 14 | 14 | | Sec. 773.221. DEFINITIONS. In this subchapter: |
|---|
| 15 | 15 | | (1) "Commission" means the Health and Human Services |
|---|
| 16 | 16 | | Commission. |
|---|
| 17 | 17 | | (2) "Grant program" means the mobile stroke unit grant |
|---|
| 18 | 18 | | program established under this subchapter. |
|---|
| 19 | 19 | | (3) "Mobile stroke unit" means a specialized emergency |
|---|
| 20 | 20 | | medical services vehicle that: |
|---|
| 21 | 21 | | (A) is equipped with a mobile computed tomography |
|---|
| 22 | 22 | | scanner and other necessary medical equipment and medications for |
|---|
| 23 | 23 | | diagnosing and treating an individual who suffers a stroke; |
|---|
| 24 | 24 | | (B) is staffed with personnel trained to diagnose |
|---|
| 25 | 25 | | and provide acute stroke treatment to an individual outside of a |
|---|
| 26 | 26 | | hospital setting; and |
|---|
| 27 | 27 | | (C) has a neurologist on board the vehicle or |
|---|
| 28 | 28 | | available for consultation with the vehicle's personnel through a |
|---|
| 29 | 29 | | telemedicine medical service, as defined by Section 111.001, |
|---|
| 30 | 30 | | Occupations Code. |
|---|
| 31 | 31 | | (4) "Stroke facility" has the meaning assigned by |
|---|
| 32 | 32 | | Section 773.202. |
|---|
| 33 | 33 | | Sec. 773.222. ESTABLISHMENT AND ADMINISTRATION OF GRANT |
|---|
| 34 | 34 | | PROGRAM. The executive commissioner by rule shall establish and |
|---|
| 35 | 35 | | the commission shall administer a mobile stroke unit grant program |
|---|
| 36 | 36 | | to improve health care outcomes for individuals who suffer a stroke |
|---|
| 37 | 37 | | by providing financial assistance to stroke facilities and |
|---|
| 38 | 38 | | increasing the availability of mobile stroke units in this state. |
|---|
| 39 | 39 | | Sec. 773.223. APPLICATION. A stroke facility that holds a |
|---|
| 40 | 40 | | comprehensive (Level 1) stroke designation from the department may |
|---|
| 41 | 41 | | apply to the commission for a grant award under the grant program. |
|---|
| 42 | 42 | | Sec. 773.224. AWARD OF GRANTS. (a) The executive |
|---|
| 43 | 43 | | commissioner by rule shall establish eligibility criteria and a |
|---|
| 44 | 44 | | scoring system for the commission to award grants under the |
|---|
| 45 | 45 | | program. |
|---|
| 46 | 46 | | (b) The commission may award grants under the program to |
|---|
| 47 | 47 | | eligible applicants. |
|---|
| 48 | 48 | | (c) The commission may only award a grant in accordance with |
|---|
| 49 | 49 | | a contract between the commission and a grant recipient that |
|---|
| 50 | 50 | | includes conditions providing the commission with sufficient |
|---|
| 51 | 51 | | control to ensure the public purpose of improving public health is |
|---|
| 52 | 52 | | accomplished and the state receives a return benefit. |
|---|
| 53 | 53 | | Sec. 773.225. USE OF GRANT MONEY. A grant recipient may use |
|---|
| 54 | 54 | | money awarded under the grant program only for the recipient's |
|---|
| 55 | 55 | | capital costs associated with procuring equipment necessary to |
|---|
| 56 | 56 | | operate a mobile stroke unit, including: |
|---|
| 57 | 57 | | (1) a specialized emergency medical services vehicle; |
|---|
| 58 | 58 | | (2) a mobile computed tomography scanner; |
|---|
| 59 | 59 | | (3) medical equipment used in diagnosing or treating |
|---|
| 60 | 60 | | an individual who suffers a stroke; and |
|---|
| 61 | 61 | | (4) any other equipment the commission considers |
|---|
| 62 | 62 | | necessary or appropriate. |
|---|
| 63 | 63 | | Sec. 773.226. GRANT RECIPIENT REPORTING REQUIREMENT. A |
|---|
| 64 | 64 | | grant recipient shall annually submit to the commission a report on |
|---|
| 65 | 65 | | the recipient's use of grant money, including: |
|---|
| 66 | 66 | | (1) the health outcomes of individuals treated by the |
|---|
| 67 | 67 | | recipient's mobile stroke units; and |
|---|
| 68 | 68 | | (2) the recipient's operating expenses associated with |
|---|
| 69 | 69 | | operating mobile stroke units. |
|---|
| 70 | 70 | | Sec. 773.227. FUNDING. The commission shall award grants |
|---|
| 71 | 71 | | as provided by this subchapter from available money and any |
|---|
| 72 | 72 | | additional money appropriated for purposes of this subchapter. |
|---|
| 73 | 73 | | Sec. 773.228. GIFTS, GRANTS, AND DONATIONS. The commission |
|---|
| 74 | 74 | | may accept gifts, grants, and donations from any source that are |
|---|
| 75 | 75 | | made for the purposes of the grant program. |
|---|
| 76 | 76 | | SECTION 2. Not later than January 1, 2026, the executive |
|---|
| 77 | 77 | | commissioner of the Health and Human Services Commission shall |
|---|
| 78 | 78 | | adopt the rules necessary to implement Subchapter H-1, Chapter 773, |
|---|
| 79 | 79 | | Health and Safety Code, as added by this Act. |
|---|
| 80 | 80 | | SECTION 3. This Act takes effect September 1, 2025. |
