7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the release of a tier two form listing hazardous
10	10	chemicals that is in the possession of a political subdivision of
11	11	this state.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 505.006, Health and Safety Code, is
14	14	amended by amending Subsection (h) and adding Subsection (i) to
15	15	read as follows:
16	16	(h) Except as provided by Subsection (i) and Section
17	17	505.015, documents filed under this chapter are subject to Chapter
18	18	552, Government Code.
19	19	(i) Except as otherwise provided by this subsection, a tier
20	20	two form that is in the possession of a political subdivision of
21	21	this state is confidential and not subject to disclosure under
22	22	Chapter 552, Government Code. A political subdivision may release a
23	23	tier two form or information contained in the form to the public
24	24	only if:
25	25	(1) the tier two form or applicable information has
26	26	been made publicly available by the commission; or
27	27	(2) the information released only states the name of a
28	28	class of dangerous goods under the hazard classification system
29	29	used in the 2024 Emergency Response Guidebook published by the
30	30	United States Department of Transportation.
31	31	SECTION 2. Section 506.006, Health and Safety Code, is
32	32	amended by amending Subsection (g) and adding Subsection (h) to
33	33	read as follows:
34	34	(g) Except as provided by Subsection (h), documents
35	35	[Documents] filed under this chapter are subject to Chapter 552,
36	36	Government Code.
37	37	(h) Except as otherwise provided by this subsection, a tier
38	38	two form that is in the possession of a political subdivision of
39	39	this state is confidential and not subject to disclosure under
40	40	Chapter 552, Government Code. A political subdivision may release a
41	41	tier two form or information contained in the form to the public
42	42	only if:
43	43	(1) the tier two form or applicable information has
44	44	been made publicly available by the commission; or
45	45	(2) the information released only states the name of a

50	50	amended by amending Subsection (h) and adding Subsection (i) to
51	51	read as follows:
52	52	(h) Except as provided by Subsection (i) and Section
53	53	507.012, documents filed under this chapter are subject to Chapter
54	54	552, Government Code.
55	55	(i) Except as otherwise provided by this subsection, a tier
56	56	two form that is in the possession of a political subdivision of
57	57	this state is confidential and not subject to disclosure under
58	58	Chapter 552, Government Code. A political subdivision may release a
59	59	tier two form or information contained in the form to the public
60	60	only if:

67	67	SECTION 4. This Act takes effect September 1, 2025.
