16 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

17 | 13 | | SECTION 1. Subchapter DD, Chapter 2306, Government Code, is |
---|
18 | 14 | | amended by adding Section 2306.6741 to read as follows: |
---|
19 | 15 | | Sec. 2306.6741. WATER PRESSURE BOOSTER REQUIRED. (a) This |
---|
20 | 16 | | section applies only to a development that: |
---|
21 | 17 | | (1) has received an allocation of low income housing |
---|
22 | 18 | | tax credits under this subchapter; |
---|
23 | 19 | | (2) is a multifamily residential development whose |
---|
24 | 20 | | residential units are reserved for individuals 55 years of age and |
---|
25 | 21 | | older; and |
---|
26 | 22 | | (3) is four stories or more in height. |
---|
27 | 23 | | (b) The department shall require each development to which |
---|
28 | 24 | | this section applies to be equipped with a water pressure booster |
---|
29 | 25 | | capable of providing water to each floor of the development during |
---|
30 | 26 | | an emergency. |
---|
31 | 27 | | (c) The department may adopt rules to implement this |
---|
32 | 28 | | section. |
---|
33 | 29 | | SECTION 2. (a) In this section, "development" means a |
---|
34 | 30 | | development to which Section 2306.6741, Government Code, as added |
---|
35 | 31 | | by this Act, applies. |
---|
36 | 32 | | (b) The Texas Department of Housing and Community Affairs |
---|
37 | | - | shall ensure that each development whose construction is completed |
---|
38 | | - | on or after January 1, 2026, complies with Section 2306.6741, |
---|
39 | | - | Government Code, as added by this Act. |
---|
40 | | - | (c) Notwithstanding Section 2306.6741, Government Code, as |
---|
41 | | - | added by this Act, a development whose construction is completed on |
---|
42 | | - | or before December 31, 2025, is not required to comply with that |
---|
43 | | - | section until January 1, 2030. |
---|
44 | | - | (d) Not later than March 1, 2030, the Texas Department of |
---|
| 33 | + | shall ensure that each development is in compliance with Section |

| 34 | + | 2306.6741, Government Code, as added by this Act, not later than |
---|
| 35 | + | December 31, 2026. The department may establish a process to carry |
---|
| 36 | + | out this subsection in phases. |

45 | 38 | | Housing and Community Affairs shall prepare and submit to the |

46 | 39 | | legislature a written report on: |

47 | 40 | | (1) the overall number of developments in compliance |
---|
48 | 41 | | with Section 2306.6741, Government Code, as added by this Act; and |
---|
49 | 42 | | (2) for any development that is not in compliance with |
---|
50 | 43 | | that section, the reason for the noncompliance and any actions |
---|
51 | 44 | | taken by the department to ensure compliance with that section. |
---|
52 | 45 | | SECTION 3. This Act takes effect September 1, 2025. |
