117 A BILL TO BE ENTITLED
128 AN ACT
139 relating to required water pressure boosters for certain housing
1410 developments that receive an allocation of low income housing tax
1511 credits.
1612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1713 SECTION 1. Subchapter DD, Chapter 2306, Government Code, is
1814 amended by adding Section 2306.6741 to read as follows:
1915 Sec. 2306.6741. WATER PRESSURE BOOSTER REQUIRED. (a) This
2016 section applies only to a development that:
2117 (1) has received an allocation of low income housing
2218 tax credits under this subchapter;
2319 (2) is a multifamily residential development whose
2420 residential units are reserved for individuals 55 years of age and
2521 older; and
2622 (3) is four stories or more in height.
2723 (b) The department shall require each development to which
2824 this section applies to be equipped with a water pressure booster
2925 capable of providing water to each floor of the development during
3026 an emergency.
3127 (c) The department may adopt rules to implement this
3228 section.
3329 SECTION 2. (a) In this section, "development" means a
3430 development to which Section 2306.6741, Government Code, as added
3531 by this Act, applies.
3632 (b) The Texas Department of Housing and Community Affairs
37- shall ensure that each development whose construction is completed
38- on or after January 1, 2026, complies with Section 2306.6741,
39- Government Code, as added by this Act.
40- (c) Notwithstanding Section 2306.6741, Government Code, as
41- added by this Act, a development whose construction is completed on
42- or before December 31, 2025, is not required to comply with that
43- section until January 1, 2030.
44- (d) Not later than March 1, 2030, the Texas Department of
33+ shall ensure that each development is in compliance with Section
34+ 2306.6741, Government Code, as added by this Act, not later than
35+ December 31, 2026. The department may establish a process to carry
36+ out this subsection in phases.
37+ (c) Not later than March 1, 2027, the Texas Department of
4538 Housing and Community Affairs shall prepare and submit to the
4639 legislature a written report on:
4740 (1) the overall number of developments in compliance
4841 with Section 2306.6741, Government Code, as added by this Act; and
4942 (2) for any development that is not in compliance with
5043 that section, the reason for the noncompliance and any actions
5144 taken by the department to ensure compliance with that section.
5245 SECTION 3. This Act takes effect September 1, 2025.
