| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|---|
| 14 | 14 | | is amended by adding Section 201.626 to read as follows: |
|---|
| 15 | 15 | | Sec. 201.626. USE OF COMPOST. (a) In this section, |
|---|
| 16 | 16 | | "compost" means the disinfected and stabilized product of the |
|---|
| 17 | 17 | | decomposition process that is used or sold for use as a soil |
|---|
| 18 | 18 | | amendment, artificial top soil, growing medium amendment, or other |
|---|
| 19 | 19 | | similar uses. |
|---|
| 20 | 20 | | (b) The department shall use compost: |
|---|
| 21 | 21 | | (1) for at least 25 percent of the soil required for |
|---|
| 22 | 22 | | landscaping projects; and |
|---|
| 23 | 23 | | (2) when feasible in capital construction and road |
|---|
| 24 | 24 | | maintenance projects. |
|---|
| 25 | 25 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 26 | 26 | | a contract for a landscaping, capital construction, or road |
|---|
| 27 | 27 | | maintenance project for which the Texas Department of |
|---|
| 28 | 28 | | Transportation first advertises or otherwise solicits bids, |
|---|
| 29 | 29 | | proposals, offers, or qualifications, or makes a similar |
|---|
| 30 | 30 | | solicitation, on or after the effective date of this Act. A contract |
|---|
| 31 | 31 | | for which the Texas Department of Transportation first advertises |
|---|
| 32 | 32 | | or otherwise solicits bids, proposals, offers, or qualifications, |
|---|
| 33 | 33 | | or makes a similar solicitation, before the effective date of this |
|---|
| 34 | 34 | | Act is governed by the law in effect on the date the advertisement |
|---|
| 35 | 35 | | or solicitation is made, and that law is continued in effect for |
|---|
| 36 | 36 | | that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2025. |
