77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to use of compost in landscaping, capital construction,
1010 and road maintenance projects by the Texas Department of
1111 Transportation.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter H, Chapter 201, Transportation Code,
1414 is amended by adding Section 201.626 to read as follows:
1515 Sec. 201.626. USE OF COMPOST. (a) In this section,
1616 "compost" means the disinfected and stabilized product of the
1717 decomposition process that is used or sold for use as a soil
1818 amendment, artificial top soil, growing medium amendment, or other
1919 similar uses.
2020 (b) The department shall use compost:
2121 (1) for at least 25 percent of the soil required for
2222 landscaping projects; and
2323 (2) when feasible in capital construction and road
2424 maintenance projects.
2525 SECTION 2. The changes in law made by this Act apply only to
2626 a contract for a landscaping, capital construction, or road
2727 maintenance project for which the Texas Department of
2828 Transportation first advertises or otherwise solicits bids,
2929 proposals, offers, or qualifications, or makes a similar
3030 solicitation, on or after the effective date of this Act. A contract
3131 for which the Texas Department of Transportation first advertises
3232 or otherwise solicits bids, proposals, offers, or qualifications,
3333 or makes a similar solicitation, before the effective date of this
3434 Act is governed by the law in effect on the date the advertisement
3535 or solicitation is made, and that law is continued in effect for
3636 that purpose.
3737 SECTION 3. This Act takes effect September 1, 2025.
