9 | 9 | | relating to the use of unclaimed lottery prize money to benefit the |

10 | 10 | | child-care services program administered by the Texas Workforce |
---|
11 | 11 | | Commission. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Section 466.408(b), Government Code, is amended |
---|
14 | 14 | | to read as follows: |
---|
15 | 15 | | (b) If a claim is not made for prize money on or before the |
---|
16 | 16 | | 180th day after the date on which the winner was selected, the prize |
---|
17 | 17 | | money shall be used in the following order of priority: |
---|
18 | 18 | | (1) subject to legislative appropriation, not more |
---|
19 | 19 | | than $20 million in prize money each year may be deposited to the |
---|
20 | 20 | | Department of State Health Services state-owned multicategorical |
---|
21 | 21 | | teaching hospital account, which is an account in the general |
---|
22 | 22 | | revenue fund, or appropriated from that account to provide indigent |
---|
23 | 23 | | health care services as specified in Chapter 61, Health and Safety |
---|
24 | 24 | | Code; |
---|
25 | 25 | | (2) not more than $5 million in prize money each year |
---|
26 | 26 | | may be appropriated to the Health and Human Services Commission and |
---|
27 | 27 | | shall be used to support the provision of inpatient hospital |
---|
28 | 28 | | services in hospitals located in the 15 counties that comprise the |
---|
29 | 29 | | Texas-Mexico border area, with payment for those services to be not |
---|
30 | 30 | | less than the amount established under the Tax Equity and Fiscal |
---|
31 | 31 | | Responsibility Act of 1982 (TEFRA) cost reimbursement methodology |
---|
32 | 32 | | for the hospital providing the services; |
---|
33 | 33 | | (3) [the remaining amount,] not more than [to exceed] |
---|
34 | 34 | | $5 million in prize money in each state fiscal year less any amount |
---|
35 | 35 | | deposited in the fund in that year attributable to the lottery game |
---|
36 | 36 | | operated under Section 466.027[,] shall be deposited to the fund |
---|
37 | 37 | | for veterans' assistance; [and] |
---|
38 | 38 | | (4) the remaining amount, not to exceed $5 million in |
---|
39 | 39 | | prize money in each state fiscal year, shall be deposited to the |
---|
40 | 40 | | general revenue fund for appropriation only to fund the child-care |
---|
41 | 41 | | services program administered by the Texas Workforce Commission; |
---|
42 | 42 | | and |
---|
43 | 43 | | (5) all prize money subject to this section and not |
---|
44 | 44 | | deposited or appropriated in accordance with Subdivision (1), (2), |
---|
45 | 45 | | [or] (3), or (4) shall be deposited to the credit of the foundation |
---|
46 | 46 | | school fund. |
---|
47 | 47 | | SECTION 2. The change in law made by this Act to Section |
---|
48 | 48 | | 466.408, Government Code, applies only to an unclaimed prize for a |
---|
49 | 49 | | lottery game for which the winner was selected on or after the |
---|
50 | 50 | | effective date of this Act. An unclaimed prize for which the winner |
---|
51 | 51 | | was selected before the effective date of this Act is governed by |
---|
52 | 52 | | the law as it existed immediately before the effective date of this |
---|
53 | 53 | | Act, and that law is continued in effect for that purpose. |
---|
54 | 54 | | SECTION 3. This Act takes effect September 1, 2025. |
