77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an exemption from residential mortgage loan originator
1010 licensing requirements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 157.0121(b), Finance Code, is amended to
1313 read as follows:
1414 (b) The following individuals are exempt from this chapter:
1515 (1) a registered mortgage loan originator when acting
1616 for:
1717 (A) a depository institution;
1818 (B) a subsidiary of a depository institution that
1919 is:
2020 (i) owned and controlled by the depository
2121 institution; and
2222 (ii) regulated by a federal banking agency;
2323 or
2424 (C) an institution regulated by the Farm Credit
2525 Administration;
2626 (2) an individual who offers or negotiates the terms
2727 of a residential mortgage loan with or on behalf of an immediate
2828 family member of the individual;
2929 (3) a licensed attorney who negotiates the terms of a
3030 residential mortgage loan on behalf of a client as an ancillary
3131 matter to the attorney's representation of the client, unless the
3232 attorney:
3333 (A) takes a residential mortgage loan
3434 application; and
3535 (B) offers or negotiates the terms of a
3636 residential mortgage loan;
3737 (4) an individual who offers or negotiates terms of a
3838 residential mortgage loan secured by a dwelling that serves as the
3939 individual's residence;
4040 (5) any owner of residential real estate who in any
4141 12-consecutive-month period makes no more than three [five]
4242 residential mortgage loans to purchasers of the property for all or
4343 part of the purchase price of the residential real estate against
4444 which the mortgage is secured; and
4545 (6) an individual who is exempt as provided by Section
4646 180.003(b).
4747 SECTION 2. This Act takes effect September 1, 2025.
