69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to enhancing the criminal penalty for the offense of
912 intoxication manslaughter in certain circumstances.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 49.09(b-2), Penal Code, is amended to
1215 read as follows:
1316 (b-2) An offense under Section 49.08 is a felony of the
1417 first degree if it is shown on the trial of the offense that the
1518 person caused the death of:
1619 (1) a person described by Subsection (b-1); or
1720 (2) more than one person during the same criminal
1821 transaction.
1922 SECTION 2. The change in law made by this Act applies only
2023 to an offense committed on or after the effective date of this Act.
2124 An offense committed before the effective date of this Act is
2225 governed by the law in effect on the date the offense was committed,
2326 and the former law is continued in effect for that purpose. For
2427 purposes of this section, an offense was committed before the
2528 effective date of this Act if any element of the offense occurred
2629 before that date.
2730 SECTION 3. This Act takes effect September 1, 2025.
