| 10 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 14 | | SECTION 1. Section 49.09(b-2), Penal Code, is amended to |
|---|
| 12 | 15 | | read as follows: |
|---|
| 13 | 16 | | (b-2) An offense under Section 49.08 is a felony of the |
|---|
| 14 | 17 | | first degree if it is shown on the trial of the offense that the |
|---|
| 15 | 18 | | person caused the death of: |
|---|
| 16 | 19 | | (1) a person described by Subsection (b-1); or |
|---|
| 17 | 20 | | (2) more than one person during the same criminal |
|---|
| 18 | 21 | | transaction. |
|---|
| 19 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 20 | 23 | | to an offense committed on or after the effective date of this Act. |
|---|
| 21 | 24 | | An offense committed before the effective date of this Act is |
|---|
| 22 | 25 | | governed by the law in effect on the date the offense was committed, |
|---|
| 23 | 26 | | and the former law is continued in effect for that purpose. For |
|---|
| 24 | 27 | | purposes of this section, an offense was committed before the |
|---|
| 25 | 28 | | effective date of this Act if any element of the offense occurred |
|---|
| 26 | 29 | | before that date. |
|---|
| 27 | 30 | | SECTION 3. This Act takes effect September 1, 2025. |
