77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting certain conduct by physicians and health
1010 care providers involving gender transitioning and gender
1111 reassignment procedures and treatments for children; creating a
1212 criminal offense.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 161.702, Health and Safety Code, as
1515 added by Chapter 335 (S.B. 14), Acts of the 88th Legislature,
1616 Regular Session, 2023, is amended to read as follows:
1717 Sec. 161.702. PROHIBITED PROVISION OR FACILITATION OF
1818 GENDER TRANSITIONING OR GENDER REASSIGNMENT PROCEDURES AND
1919 TREATMENTS TO CERTAIN CHILDREN. For the purpose of transitioning a
2020 child's biological sex as determined by the sex organs,
2121 chromosomes, and endogenous profiles of the child or affirming the
2222 child's perception of the child's sex if that perception is
2323 inconsistent with the child's biological sex, a physician or health
2424 care provider may not knowingly:
2525 (1) perform a surgery that sterilizes the child,
2626 including:
2727 (A) castration;
2828 (B) vasectomy;
2929 (C) hysterectomy;
3030 (D) oophorectomy;
3131 (E) metoidioplasty;
3232 (F) orchiectomy;
3333 (G) penectomy;
3434 (H) phalloplasty; and
3535 (I) vaginoplasty;
3636 (2) perform a mastectomy;
3737 (3) provide, prescribe, administer, or dispense any of
3838 the following prescription drugs that induce transient or permanent
3939 infertility:
4040 (A) puberty suppression or blocking prescription
4141 drugs to stop or delay normal puberty;
4242 (B) supraphysiologic doses of testosterone to
4343 females; or
4444 (C) supraphysiologic doses of estrogen to males;
4545 [or]
4646 (4) remove any otherwise healthy or non-diseased body
4747 part or tissue; or
4848 (5) refer a child to a health care practitioner who is
4949 licensed or otherwise authorized to provide health care in another
5050 state, to facilitate the child's ability to receive in the other
5151 state a procedure or treatment that would otherwise be prohibited
5252 by this section if the procedure or treatment occurred in this
5353 state.
5454 SECTION 2. Subchapter X, Chapter 161, Health and Safety
5555 Code, as added by Chapter 335 (S.B. 14), Acts of the 88th
5656 Legislature, Regular Session, 2023, is amended by adding Section
5757 161.707 to read as follows:
5858 Sec. 161.707. CRIMINAL OFFENSE. (a) A person who is a
5959 physician or health care provider commits an offense if the person
6060 knowingly violates Section 161.702.
6161 (b) It is an exception to the application of this section
6262 that the actor engaged in conduct authorized under Section 161.703.
6363 (c) An offense under this section is a felony of the third
6464 degree.
6565 SECTION 3. This Act takes effect September 1, 2025.
