15 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 12 | | SECTION 1. Section 552.003(1), Government Code, is amended |
---|
17 | 13 | | to read as follows: |
---|
18 | 14 | | (1) "Governmental body": |
---|
19 | 15 | | (A) means: |
---|
20 | 16 | | (i) a board, commission, department, |
---|
21 | 17 | | committee, institution, agency, or office that is within or is |
---|
22 | 18 | | created by the executive or legislative branch of state government |
---|
23 | 19 | | and that is directed by one or more elected or appointed members; |
---|
24 | 20 | | (ii) a county commissioners court in the |
---|
25 | 21 | | state; |
---|
26 | 22 | | (iii) a municipal governing body in the |
---|
27 | 23 | | state; |
---|
28 | 24 | | (iv) a deliberative body that has |
---|
29 | 25 | | rulemaking or quasi-judicial power and that is classified as a |
---|
30 | 26 | | department, agency, or political subdivision of a county or |
---|
31 | 27 | | municipality; |
---|
32 | 28 | | (v) a school district board of trustees; |
---|
33 | 29 | | (vi) a county board of school trustees; |
---|
34 | 30 | | (vii) a county board of education; |
---|
35 | 31 | | (viii) the governing board of a special |
---|
36 | 32 | | district; |
---|
37 | 33 | | (ix) the governing body of a nonprofit |
---|
38 | 34 | | corporation organized under Chapter 67, Water Code, that provides a |
---|
39 | 35 | | water supply or wastewater service, or both, and is exempt from ad |
---|
40 | 36 | | valorem taxation under Section 11.30, Tax Code; |
---|
41 | 37 | | (x) a local workforce development board |
---|
42 | 38 | | created under Section 2308.253; |
---|
43 | 39 | | (xi) a nonprofit corporation that is |
---|
44 | 40 | | eligible to receive funds under the federal community services |
---|
45 | 41 | | block grant program and that is authorized by this state to serve a |
---|
46 | 42 | | geographic area of the state; |
---|
47 | 43 | | (xii) a confinement facility operated under |
---|
48 | 44 | | a contract with any division of the Texas Department of Criminal |
---|
49 | 45 | | Justice; |
---|
50 | 46 | | (xiii) a civil commitment housing facility |
---|
51 | 47 | | owned, leased, or operated by a vendor under contract with the state |
---|
52 | 48 | | as provided by Chapter 841, Health and Safety Code; |
---|
53 | 49 | | (xiv) an entity that receives public funds |
---|
54 | 50 | | in the current or preceding state fiscal year to manage the daily |
---|
55 | 51 | | operations or restoration of the Alamo, or an entity that oversees |
---|
56 | 52 | | such an entity; [and] |
---|
57 | 53 | | (xv) the part, section, or portion of an |
---|
58 | 54 | | organization, corporation, commission, committee, institution, or |
---|
59 | 55 | | agency that spends or that is supported in whole or in part by |
---|
60 | 56 | | public funds; and |
---|
61 | 57 | | (xvi) a nonprofit state association or |
---|
62 | 58 | | organization primarily composed of similarly situated political |
---|
63 | 59 | | subdivisions; and |
---|
64 | 60 | | (B) does not include: |
---|
65 | 61 | | (i) the judiciary; or |
---|
66 | 62 | | (ii) an economic development entity whose |
---|
67 | 63 | | mission or purpose is to develop and promote the economic growth of |
---|
68 | 64 | | a state agency or political subdivision with which the entity |
---|
69 | 65 | | contracts if: |
---|
70 | 66 | | (a) the entity does not receive $1 |
---|
71 | 67 | | million or more in public funds from a single state agency or |
---|
72 | 68 | | political subdivision in the current or preceding state fiscal |
---|
73 | 69 | | year; or |
---|
74 | 70 | | (b) the entity: |
---|
75 | 71 | | (1) either: |
---|
76 | 72 | | (A) does not have the |
---|
77 | 73 | | authority to make decisions or recommendations on behalf of a state |
---|
78 | 74 | | agency or political subdivision regarding tax abatements or tax |
---|
79 | 75 | | incentives; or |
---|
80 | 76 | | (B) does not require an |
---|
81 | 77 | | officer of the state agency or political subdivision to hold office |
---|
82 | 78 | | as a member of the board of directors of the entity; |
---|
83 | 79 | | (2) does not use staff or office |
---|
84 | 80 | | space of the state agency or political subdivision for no or nominal |
---|
85 | 81 | | consideration, unless the space is available to the public; |
---|
86 | 82 | | (3) to a reasonable degree, |
---|
87 | 83 | | tracks the entity's receipt and expenditure of public funds |
---|
88 | 84 | | separately from the entity's receipt and expenditure of private |
---|
89 | 85 | | funds; and |
---|
90 | 86 | | (4) provides at least quarterly |
---|
91 | 87 | | public reports to the state agency or political subdivision |
---|
92 | 88 | | regarding work performed on behalf of the state agency or political |
---|
93 | 89 | | subdivision. |
---|
94 | 90 | | SECTION 2. The change in law made by this Act applies only |
---|
95 | 91 | | to a request for public information received by a governmental body |
---|
96 | 92 | | or an officer for public information on or after the effective date |
---|
97 | 93 | | of this Act. |
---|
98 | 94 | | SECTION 3. This Act takes effect September 1, 2025. |
