10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter A, Chapter 92, Property Code, is | |
12 | 12 | amended by adding Section 92.0115 to read as follows: | |
13 | 13 | Sec. 92.0115. DISCLOSURE OF CERTAIN FEES. (a) A fixed, | |
14 | 14 | recurring fee other than rent for a dwelling that a landlord intends | |
15 | 15 | to charge a tenant under a written lease must be disclosed by the | |
16 | 16 | landlord to the tenant before a lease for the dwelling is signed by | |
17 | 17 | the tenant. Disclosure of the amount of a fee in a written lease or | |
18 | 18 | an amendment to a written lease satisfies the requirement of this | |
19 | 19 | subsection. | |
20 | 20 | (b) A tenant is not obligated to pay a fee described by | |
21 | 21 | Subsection (a) that is not disclosed as required by that | |
22 | 22 | subsection. | |
23 | 23 | (c) Nothing in this section may be construed to limit the | |
24 | 24 | ability of a landlord and tenant to enter into an agreement during a | |
25 | 25 | lease term under which the landlord charges a recurring fee to the | |
26 | 26 | tenant for goods or services. | |
27 | 27 | SECTION 2. Section 92.0115, Property Code, as added by this | |
28 | 28 | Act, applies only to a fee under a lease entered into or renewed on | |
29 | 29 | or after the effective date of this Act. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2025. |
