88 AN ACT
99 relating to creating a reimbursement program to reimburse certain
1010 supplemental nutrition assistance program recipients for the cost
1111 of certain food delivery service fees.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1414 is amended by adding Section 33.033 to read as follows:
1515 Sec. 33.033. FOOD DELIVERY FEE REIMBURSEMENT PROGRAM FOR
1616 CERTAIN ELIGIBLE SNAP RECIPIENTS. (a) In this section, "eligible
1717 recipient" means a recipient of supplemental nutrition assistance
1818 program benefits who:
1919 (1) is 65 years of age or older; or
2020 (2) has a disability, as defined by the Americans with
2121 Disabilities Act of 1990 (42 U.S.C. Section 12101 et seq.).
2222 (b) From appropriated money available for that purpose, the
2323 commission shall develop and implement a reimbursement program
2424 under which an eligible recipient may obtain financial assistance
2525 in the form of reimbursement to cover the cost of delivery service
2626 fees incurred by the recipient in connection with the purchase of
2727 eligible food items under the supplemental nutrition assistance
2828 program. In implementing the reimbursement program, the commission
2929 shall:
3030 (1) prescribe the form and manner for an eligible
3131 recipient to request reimbursement, which may require the recipient
3232 to submit an application online, by mail, or in person; and
3333 (2) ensure that supplemental nutrition assistance
3434 program benefits are not used to reimburse the cost of delivery
3535 service fees under this section.
3636 (c) The executive commissioner shall adopt rules necessary
3737 to implement this section, including rules that:
3838 (1) establish a reimbursement methodology for
3939 determining the reimbursement amount that an eligible recipient may
4040 receive to cover the cost of a delivery service fee assessed in
4141 connection with the purchase of eligible food items, which may
4242 include limits on:
4343 (A) the total reimbursement amount that an
4444 eligible recipient may receive to cover the cost of the delivery
4545 service fee; and
4646 (B) the total number of purchases for which an
4747 eligible recipient may receive reimbursement over a period of time
4848 the commission specifies; and
4949 (2) restrict an eligible recipient from obtaining
5050 reimbursement to cover the cost of delivery of a purchase that
5151 includes items that are not eligible for purchase using
5252 supplemental nutrition assistance benefits.
5353 SECTION 2. If before implementing any provision of this Act
5454 a state agency determines that a waiver or authorization from a
5555 federal agency is necessary for implementation of that provision,
5656 the agency affected by the provision shall request the waiver or
5757 authorization and may delay implementing that provision until the
5858 waiver or authorization is granted.
5959 SECTION 3. This Act takes effect September 1, 2025.
