9 | 9 | | relating to creating a reimbursement program to reimburse certain |

10 | 10 | | supplemental nutrition assistance program recipients for the cost |
---|
11 | 11 | | of certain food delivery service fees. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, |
---|
14 | 14 | | is amended by adding Section 33.033 to read as follows: |
---|
15 | 15 | | Sec. 33.033. FOOD DELIVERY FEE REIMBURSEMENT PROGRAM FOR |
---|
16 | 16 | | CERTAIN ELIGIBLE SNAP RECIPIENTS. (a) In this section, "eligible |
---|
17 | 17 | | recipient" means a recipient of supplemental nutrition assistance |
---|
18 | 18 | | program benefits who: |
---|
19 | 19 | | (1) is 65 years of age or older; or |
---|
20 | 20 | | (2) has a disability, as defined by the Americans with |
---|
21 | 21 | | Disabilities Act of 1990 (42 U.S.C. Section 12101 et seq.). |
---|
22 | 22 | | (b) From appropriated money available for that purpose, the |
---|
23 | 23 | | commission shall develop and implement a reimbursement program |
---|
24 | 24 | | under which an eligible recipient may obtain financial assistance |
---|
25 | 25 | | in the form of reimbursement to cover the cost of delivery service |
---|
26 | 26 | | fees incurred by the recipient in connection with the purchase of |
---|
27 | 27 | | eligible food items under the supplemental nutrition assistance |
---|
28 | 28 | | program. In implementing the reimbursement program, the commission |
---|
29 | 29 | | shall: |
---|
30 | 30 | | (1) prescribe the form and manner for an eligible |
---|
31 | 31 | | recipient to request reimbursement, which may require the recipient |
---|
32 | 32 | | to submit an application online, by mail, or in person; and |
---|
33 | 33 | | (2) ensure that supplemental nutrition assistance |
---|
34 | 34 | | program benefits are not used to reimburse the cost of delivery |
---|
35 | 35 | | service fees under this section. |
---|
36 | 36 | | (c) The executive commissioner shall adopt rules necessary |
---|
37 | 37 | | to implement this section, including rules that: |
---|
38 | 38 | | (1) establish a reimbursement methodology for |
---|
39 | 39 | | determining the reimbursement amount that an eligible recipient may |
---|
40 | 40 | | receive to cover the cost of a delivery service fee assessed in |
---|
41 | 41 | | connection with the purchase of eligible food items, which may |
---|
42 | 42 | | include limits on: |
---|
43 | 43 | | (A) the total reimbursement amount that an |
---|
44 | 44 | | eligible recipient may receive to cover the cost of the delivery |
---|
45 | 45 | | service fee; and |
---|
46 | 46 | | (B) the total number of purchases for which an |
---|
47 | 47 | | eligible recipient may receive reimbursement over a period of time |
---|
48 | 48 | | the commission specifies; and |
---|
49 | 49 | | (2) restrict an eligible recipient from obtaining |
---|
50 | 50 | | reimbursement to cover the cost of delivery of a purchase that |
---|
51 | 51 | | includes items that are not eligible for purchase using |
---|
52 | 52 | | supplemental nutrition assistance benefits. |
---|
53 | 53 | | SECTION 2. If before implementing any provision of this Act |
---|
54 | 54 | | a state agency determines that a waiver or authorization from a |
---|
55 | 55 | | federal agency is necessary for implementation of that provision, |
---|
56 | 56 | | the agency affected by the provision shall request the waiver or |
---|
57 | 57 | | authorization and may delay implementing that provision until the |
---|
58 | 58 | | waiver or authorization is granted. |
---|
59 | 59 | | SECTION 3. This Act takes effect September 1, 2025. |
