611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to common law public nuisance claims.
914 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1116 amended by adding Chapter 100C to read as follows:
1217 CHAPTER 100C. CIVIL ACTIONS RELATED TO PUBLIC NUISANCES
1318 Sec. 100C.001. DEFINITION. In this chapter, "public
1419 nuisance claim" means a request in a civil action brought by a
1520 private party or a political subdivision of this state to recover
1621 damages, abatement, or other relief for a public nuisance under the
1722 common law of this state, whether asserted as a cause of action or
1823 an injury.
1924 Sec. 100C.002. LIMITATIONS ON COMMON LAW PUBLIC NUISANCE
2025 CLAIMS. (a) A public nuisance claim is not cognizable in this
2126 state if it seeks relief arising from:
2227 (1) an action or condition that is authorized,
2328 licensed, approved, or mandated by a statute, ordinance,
2429 regulation, permit, order, rule, or other similar measure issued,
2530 adopted, promulgated, or approved by the federal government, a
2631 federal agency, this state, or an agency or political subdivision
2732 of this state;
2833 (2) an action or condition that occurs or exists in a
2934 context where a statutory cause of action or administrative
3035 enforcement mechanism already exists to address conduct that is
3136 injurious to the public; or
3237 (3) a product or a claim based on the manufacturing,
3338 distributing, selling, labeling, or marketing of a product,
3439 regardless of whether the product is defective.
3540 (b) The aggregation of multiple injuries to individuals or
3641 of private nuisances does not constitute a public nuisance or give
3742 rise to a public nuisance claim.
3843 (c) This section may not be construed to limit a claimant
3944 from obtaining relief provided by other law.
4045 Sec. 100C.003. RELATIONSHIP TO COMMON LAW. To the extent of
4146 a conflict between this chapter and the common law of public
4247 nuisance, this chapter controls. Otherwise, this chapter
4348 supplements the common law of public nuisance, both as to the claim
4449 and defenses.
4550 SECTION 2. Chapter 100C, Civil Practice and Remedies Code,
4651 as added by this Act, applies only to an action filed on or after the
4752 effective date of this Act.
4853 SECTION 3. This Act takes effect immediately if it receives
4954 a vote of two-thirds of all the members elected to each house, as
5055 provided by Section 39, Article III, Texas Constitution. If this
5156 Act does not receive the vote necessary for immediate effect, this
5257 Act takes effect September 1, 2025.
