1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the transfer of certain public school students who are
1414 children of peace officers.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 12A.004(a), Education Code, is amended
1717 to read as follows:
1818 (a) A local innovation plan may not provide for the
1919 exemption of a district designated as a district of innovation from
2020 the following provisions of this title:
2121 (1) a state or federal requirement applicable to an
2222 open-enrollment charter school operating under Subchapter D,
2323 Chapter 12;
2424 (2) Subchapters A, C, D, and E, Chapter 11, except that
2525 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2626 Section 11.162;
2727 (3) transfers of students who are the children of
2828 peace officers under Section 25.0344;
2929 (4) [(3)] state curriculum and graduation
3030 requirements adopted under Chapter 28; and
3131 (5) [(4)] academic and financial accountability and
3232 sanctions under Chapters 39 and 39A.
3333 SECTION 2. Section 25.0344, Education Code, as added by
3434 Chapter 322 (H.B. 1959), Acts of the 88th Legislature, Regular
3535 Session, 2023, is amended by amending Subsection (b) and adding
3636 Subsections (e) and (f) to read as follows:
3737 (b) On request of a peace officer who is a parent of or
3838 person standing in parental relation to a student, the board of
3939 trustees of a school district or the board's designee shall
4040 transfer the student to:
4141 (1) another district campus; or
4242 (2) any other [to another] school district in this
4343 state, regardless of whether the sending district and the receiving
4444 district have entered into [under] an agreement under Section
4545 25.035.
4646 (e) Notwithstanding any other law, both the sending
4747 district and the receiving district must approve a transfer under
4848 this section without exception.
4949 (f) A school district may not charge a tuition fee under
5050 Section 25.038 to a student who transfers to the district under this
5151 section.
5252 SECTION 3. Section 12A.004(a), Education Code, as amended
5353 by this Act, applies only to a local innovation plan adopted or
5454 renewed on or after the effective date of this Act. A local
5555 innovation plan adopted or renewed before the effective date of
5656 this Act is governed by the law in effect on the date the plan was
5757 adopted or renewed, and the former law is continued in effect for
5858 that purpose.
5959 SECTION 4. This Act applies beginning with the 2025-2026
6060 school year.
6161 SECTION 5. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2025.
