77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility requirements for grants under programs
1010 of the Texas Commission on Environmental Quality.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 5.124(f), Water Code, is amended to read
1313 as follows:
1414 (f) A grant may be made by direct award only if:
1515 (1) the executive director determines that:
1616 (A) selection of recipients by the solicitation
1717 of proposals or applications is not feasible; and
1818 (B) awarding the grant directly is in the best
1919 interest of the state;
2020 (2) eligibility for the grant is limited to:
2121 (A) an agency or political subdivision of this
2222 state or of another state;
2323 (B) a state institution of higher learning of
2424 this state or of another state, including any part or service of the
2525 institution; [or]
2626 (C) an agency of the United States; or
2727 (D) a nonprofit organization and the grant is
2828 awarded for the purpose of funding projects implementing a
2929 comprehensive conservation and management plan under the Federal
3030 Water Pollution Control Act (33 U.S.C. Section 1251 et seq.) for a
3131 national estuary located in this state; or
3232 (3) the grant is awarded to a person established or
3333 authorized to develop or implement a comprehensive conservation and
3434 management plan under Section 320, Federal Water Pollution Control
3535 Act (33 U.S.C. Section 1330), for a national estuary in this state.
3636 SECTION 2. This Act takes effect September 1, 2025.
