88 AN ACT
99 relating to the construction of certain concrete batch plants.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1212 Code, is amended by adding Section 382.051995 to read as follows:
1313 Sec. 382.051995. EXTENSION FOR CONSTRUCTION OF CONCRETE
1414 BATCH PLANT; NOTICE TO STATE SENATOR AND STATE REPRESENTATIVE. (a)
1515 The executive director may grant a person authorized under a
1616 standard permit issued under Section 382.05195 or Section 382.05198
1717 to construct a concrete plant that performs wet batching, dry
1818 batching, or central mixing only one extension to any deadline to
1919 begin construction of the plant incorporated in the standard
2020 permit. The extension may not exceed 90 days.
2121 (b) If a person granted an extension described by Subsection
2222 (a) fails to begin construction within the time allotted under the
2323 authorization to use the standard permit or the extension period,
2424 the person must submit a new application for an authorization to use
2525 the standard permit before beginning construction.
2626 (c) On receiving a request to extend a deadline under
2727 Subsection (a), the executive director shall send notice of the
2828 request to the state senator and representative who represent the
2929 area in which the facility will be located.
3030 SECTION 2. Not later than September 1, 2026, the Texas
3131 Commission on Environmental Quality shall adopt rules necessary to
3232 implement the changes in law made by this Act.
3333 SECTION 3. Section 382.051995, Health and Safety Code, as
3434 added by this Act, applies only to an authorization to use a
3535 standard permit the application for which is filed with the Texas
3636 Commission on Environmental Quality on or after the effective date
3737 of this Act. An authorization the application for which is filed
3838 before the effective date of this Act is governed by the law in
3939 effect on the date the application was filed, and that law is
4040 continued in effect for that purpose.
4141 SECTION 4. This Act takes effect September 1, 2025.
