| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Section 382.051995 to read as follows: |
|---|
| 13 | 13 | | Sec. 382.051995. EXTENSION FOR CONSTRUCTION OF CONCRETE |
|---|
| 14 | 14 | | BATCH PLANT; NOTICE TO STATE SENATOR AND STATE REPRESENTATIVE. (a) |
|---|
| 15 | 15 | | The executive director may grant a person authorized under a |
|---|
| 16 | 16 | | standard permit issued under Section 382.05195 or Section 382.05198 |
|---|
| 17 | 17 | | to construct a concrete plant that performs wet batching, dry |
|---|
| 18 | 18 | | batching, or central mixing only one extension to any deadline to |
|---|
| 19 | 19 | | begin construction of the plant incorporated in the standard |
|---|
| 20 | 20 | | permit. The extension may not exceed 90 days. |
|---|
| 21 | 21 | | (b) If a person granted an extension described by Subsection |
|---|
| 22 | 22 | | (a) fails to begin construction within the time allotted under the |
|---|
| 23 | 23 | | authorization to use the standard permit or the extension period, |
|---|
| 24 | 24 | | the person must submit a new application for an authorization to use |
|---|
| 25 | 25 | | the standard permit before beginning construction. |
|---|
| 26 | 26 | | (c) On receiving a request to extend a deadline under |
|---|
| 27 | 27 | | Subsection (a), the executive director shall send notice of the |
|---|
| 28 | 28 | | request to the state senator and representative who represent the |
|---|
| 29 | 29 | | area in which the facility will be located. |
|---|
| 30 | 30 | | SECTION 2. Not later than September 1, 2026, the Texas |
|---|
| 31 | 31 | | Commission on Environmental Quality shall adopt rules necessary to |
|---|
| 32 | 32 | | implement the changes in law made by this Act. |
|---|
| 33 | 33 | | SECTION 3. Section 382.051995, Health and Safety Code, as |
|---|
| 34 | 34 | | added by this Act, applies only to an authorization to use a |
|---|
| 35 | 35 | | standard permit the application for which is filed with the Texas |
|---|
| 36 | 36 | | Commission on Environmental Quality on or after the effective date |
|---|
| 37 | 37 | | of this Act. An authorization the application for which is filed |
|---|
| 38 | 38 | | before the effective date of this Act is governed by the law in |
|---|
| 39 | 39 | | effect on the date the application was filed, and that law is |
|---|
| 40 | 40 | | continued in effect for that purpose. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2025. |
