77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to authorizing an optional county fee on vehicle
1010 registration in certain counties to be used for transportation
1111 projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 502.402(a) and (b-1), Transportation
1414 Code, are amended to read as follows:
1515 (a) This section applies only to:
1616 (1) a county that:
1717 (A) borders the United Mexican States; and
1818 (B) has a population of more than 250,000;
1919 (2) a county that has a population of more than 1.5
2020 million that is coterminous with a regional mobility authority;
2121 [and]
2222 (3) a county that has a population of more than 190,000
2323 and not more than 1.5 million that is coterminous with a regional
2424 mobility authority; and
2525 (4) a county that is part of a regional mobility
2626 authority created under Chapter 370 with at least two counties.
2727 (b-1) The commissioners court of a county described by
2828 Subsection (a)(1) or (3) [(a)] with a population of less than
2929 700,000 may increase the additional fee to an amount that does not
3030 exceed $20 if approved by a majority of the qualified voters of the
3131 county voting on the issue at a referendum election, which the
3232 commissioners court may order and hold for that purpose.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
