128 AN ACT
139 relating to the issuance of a certified birth record to a homeless
1410 individual.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. Subchapter A, Chapter 191, Health and Safety
1713 Code, is amended by adding Section 191.00495 to read as follows:
1814 Sec. 191.00495. BIRTH RECORD ISSUED TO HOMELESS INDIVIDUAL.
1915 (a) In this section, "homeless individual":
2016 (1) means an individual who:
2117 (A) lacks a fixed, regular, and adequate
2218 nighttime residence; or
2319 (B) has a primary nighttime residence that is:
2420 (i) a supervised publicly or privately
2521 operated shelter designed to provide temporary living
2622 accommodations, including welfare hotels, congregate shelters, and
2723 transitional housing for the mentally ill;
2824 (ii) an institution that provides a
2925 temporary residence for individuals intended to be
3026 institutionalized; or
3127 (iii) a public or private place not
3228 designed for, or ordinarily used as, a regular sleeping
3329 accommodation for human beings; and
3430 (2) does not include an individual who is imprisoned
3531 or otherwise detained in a correctional facility.
3632 (b) On request of a homeless individual, the state
3733 registrar, a local registrar, or a county clerk shall issue,
3834 without fee, a certified copy of the individual's birth record to
3935 the individual.
4036 (c) The executive commissioner by rule shall:
4137 (1) adopt a process to verify a person's status as a
4238 homeless individual; and
4339 (2) prescribe the documentation necessary for
4440 issuance of a certified copy of a birth record to a homeless
4541 individual whose status is verified through the process adopted
4642 under Subdivision (1).
4743 (d) Notwithstanding any other provision of state law, the
4844 department may not require a homeless individual to provide a
4945 physical address of the individual's residence to satisfy any
5046 requirement of this section.
5147 SECTION 2. As soon as practicable after the effective date
5248 of this Act, the executive commissioner of the Health and Human
5349 Services Commission shall adopt the rules required by Section
5450 191.00495, Health and Safety Code, as added by this Act.
5551 SECTION 3. The changes in law made by this Act apply to an
5652 application for a birth record submitted on or after the effective
5753 date of this Act. An application for a birth record submitted before
5854 the effective date of this Act is governed by the law in effect on
5955 the date the application was submitted, and the former law is
6056 continued in effect for that purpose.
6157 SECTION 4. This Act takes effect September 1, 2025.
