88 AN ACT
99 relating to the establishment by regional education service centers
1010 of regional school district health coverage advisory committees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 8, Education Code, is amended by adding
1313 Subchapter G to read as follows:
1414 SUBCHAPTER G. REGIONAL SCHOOL DISTRICT HEALTH COVERAGE ADVISORY
1515 COMMITTEES
1616 Sec. 8.251. DEFINITION. In this subchapter, "advisory
1717 committee" means a regional school district health coverage
1818 advisory committee established under this subchapter.
1919 Sec. 8.252. ESTABLISHMENT. The executive director of each
2020 regional education service center shall establish a regional school
2121 district health coverage advisory committee to study health
2222 coverage options available to employees of school districts served
2323 by that service center.
2424 Sec. 8.253. COMPOSITION. An advisory committee is composed
2525 of nine members appointed by the executive director of each
2626 regional education service center as follows:
2727 (1) three members who are superintendents employed by
2828 a school district served by the center;
2929 (2) three members who are classroom teachers employed
3030 by a school district served by the center; and
3131 (3) three members who are parents of students
3232 attending schools in school districts served by the center.
3333 Sec. 8.254. TERM OF OFFICE; REAPPOINTMENT. (a) Members of
3434 an advisory committee serve staggered two-year terms, with the
3535 terms of four members expiring January 1 of each even-numbered year
3636 and the terms of five members expiring January 1 of each
3737 odd-numbered year.
3838 (b) A person appointed to an advisory committee may be
3939 reappointed to that committee.
4040 Sec. 8.255. REMOVAL FOR CAUSE. An advisory committee
4141 member may be removed for cause by a majority vote of the remaining
4242 members of the committee.
4343 Sec. 8.256. VACANCY. The executive director of a regional
4444 education service center shall fill a vacancy on an advisory
4545 committee not later than two months after the date the vacancy
4646 occurs.
4747 Sec. 8.257. STUDY. An advisory committee shall biennially
4848 conduct a study of health coverage options available to employees
4949 of school districts served by the committee's regional education
5050 service center. The study must include, with respect to school
5151 districts in that committee's region, an assessment of health
5252 coverage plans, including cooperative health care programs, that
5353 are available on the open market or through self-funding of school
5454 district health care expenses, including for each plan:
5555 (1) the amount that would be paid by a district and
5656 district employees for premium under the plan;
5757 (2) the schedule of benefits available under the plan;
5858 and
5959 (3) whether, in obtaining the plan, some or all of the
6060 districts in the region should jointly seek health coverage under
6161 that plan as a group.
6262 Sec. 8.258. REPORT. (a) Not later than September 15 of the
6363 year in which a study is conducted under Section 8.257, an advisory
6464 committee shall submit to the executive director of the committee's
6565 regional education service center a written report detailing the
6666 committee's findings from the study. The report must include:
6767 (1) recommendations regarding the best available
6868 health care plans; and
6969 (2) an assessment of the costs and services associated
7070 with each available plan.
7171 (b) Not later than October 15 of the year in which a study is
7272 conducted under Section 8.257, the executive director of each
7373 regional education service center shall provide each board of
7474 trustees and superintendent of a school district served by the
7575 center the report submitted under Subsection (a) in an electronic
7676 format. If an advisory committee report recommends entering into a
7777 cooperative health purchasing arrangement, the executive director
7878 of that regional education service center shall include in the
7979 report provided under this subsection information regarding
8080 methods by which the center could enter into the cooperative health
8181 purchasing arrangement.
8282 (c) The executive director of each regional education
8383 service center shall schedule at least one in-person meeting with
8484 the superintendents of school districts served by the center to
8585 discuss the findings and recommendations included in an advisory
8686 committee report provided under this section.
8787 SECTION 2. (a) Not later than January 1, 2026, each
8888 executive director of a regional education service center shall
8989 appoint the members of the center's regional school district health
9090 coverage advisory committee, as required by Section 8.253,
9191 Education Code, as added by this Act.
9292 (b) Notwithstanding Section 8.254, Education Code, as added
9393 by this Act, in making the initial appointments under Subsection
9494 (a) of this section, the executive director of a regional education
9595 service center shall designate four members appointed to the
9696 center's regional school district health coverage advisory
9797 committee to serve terms expiring January 1, 2028, and five members
9898 to serve terms expiring January 1, 2027.
9999 SECTION 3. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect September 1, 2025.
