8	8	AN ACT
9	9	relating to the establishment by regional education service centers
10	10	of regional school district health coverage advisory committees.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Chapter 8, Education Code, is amended by adding
13	13	Subchapter G to read as follows:
14	14	SUBCHAPTER G. REGIONAL SCHOOL DISTRICT HEALTH COVERAGE ADVISORY
15	15	COMMITTEES
16	16	Sec. 8.251. DEFINITION. In this subchapter, "advisory
17	17	committee" means a regional school district health coverage
18	18	advisory committee established under this subchapter.
19	19	Sec. 8.252. ESTABLISHMENT. The executive director of each
20	20	regional education service center shall establish a regional school
21	21	district health coverage advisory committee to study health
22	22	coverage options available to employees of school districts served
23	23	by that service center.
24	24	Sec. 8.253. COMPOSITION. An advisory committee is composed
25	25	of nine members appointed by the executive director of each
26	26	regional education service center as follows:
27	27	(1) three members who are superintendents employed by
28	28	a school district served by the center;
29	29	(2) three members who are classroom teachers employed
30	30	by a school district served by the center; and
31	31	(3) three members who are parents of students
32	32	attending schools in school districts served by the center.
33	33	Sec. 8.254. TERM OF OFFICE; REAPPOINTMENT. (a) Members of
34	34	an advisory committee serve staggered two-year terms, with the
35	35	terms of four members expiring January 1 of each even-numbered year
36	36	and the terms of five members expiring January 1 of each
37	37	odd-numbered year.
38	38	(b) A person appointed to an advisory committee may be
39	39	reappointed to that committee.
40	40	Sec. 8.255. REMOVAL FOR CAUSE. An advisory committee
41	41	member may be removed for cause by a majority vote of the remaining
42	42	members of the committee.
43	43	Sec. 8.256. VACANCY. The executive director of a regional
44	44	education service center shall fill a vacancy on an advisory
45	45	committee not later than two months after the date the vacancy
46	46	occurs.
47	47	Sec. 8.257. STUDY. An advisory committee shall biennially
48	48	conduct a study of health coverage options available to employees
49	49	of school districts served by the committee's regional education
50	50	service center. The study must include, with respect to school
51	51	districts in that committee's region, an assessment of health
52	52	coverage plans, including cooperative health care programs, that
53	53	are available on the open market or through self-funding of school
54	54	district health care expenses, including for each plan:
55	55	(1) the amount that would be paid by a district and
56	56	district employees for premium under the plan;
57	57	(2) the schedule of benefits available under the plan;
58	58	and
59	59	(3) whether, in obtaining the plan, some or all of the
60	60	districts in the region should jointly seek health coverage under
61	61	that plan as a group.
62	62	Sec. 8.258. REPORT. (a) Not later than September 15 of the
63	63	year in which a study is conducted under Section 8.257, an advisory
64	64	committee shall submit to the executive director of the committee's
65	65	regional education service center a written report detailing the
66	66	committee's findings from the study. The report must include:
67	67	(1) recommendations regarding the best available
68	68	health care plans; and
69	69	(2) an assessment of the costs and services associated
70	70	with each available plan.
71	71	(b) Not later than October 15 of the year in which a study is
72	72	conducted under Section 8.257, the executive director of each
73	73	regional education service center shall provide each board of
74	74	trustees and superintendent of a school district served by the
75	75	center the report submitted under Subsection (a) in an electronic
76	76	format. If an advisory committee report recommends entering into a
77	77	cooperative health purchasing arrangement, the executive director
78	78	of that regional education service center shall include in the
79	79	report provided under this subsection information regarding
80	80	methods by which the center could enter into the cooperative health
81	81	purchasing arrangement.
82	82	(c) The executive director of each regional education
83	83	service center shall schedule at least one in-person meeting with
84	84	the superintendents of school districts served by the center to
85	85	discuss the findings and recommendations included in an advisory
86	86	committee report provided under this section.
87	87	SECTION 2. (a) Not later than January 1, 2026, each
88	88	executive director of a regional education service center shall
89	89	appoint the members of the center's regional school district health
90	90	coverage advisory committee, as required by Section 8.253,
91	91	Education Code, as added by this Act.
92	92	(b) Notwithstanding Section 8.254, Education Code, as added
93	93	by this Act, in making the initial appointments under Subsection
94	94	(a) of this section, the executive director of a regional education
95	95	service center shall designate four members appointed to the
96	96	center's regional school district health coverage advisory
97	97	committee to serve terms expiring January 1, 2028, and five members
98	98	to serve terms expiring January 1, 2027.
99	99	SECTION 3. This Act takes effect immediately if it receives
100	100	a vote of two-thirds of all the members elected to each house, as
101	101	provided by Section 39, Article III, Texas Constitution. If this
102	102	Act does not receive the vote necessary for immediate effect, this
103	103	Act takes effect September 1, 2025.
